SUBJECT: OFFICIAL PLAN AMENDMENT APPLICATION
APPLICANT: LIBERTY PENTECOSTAL CHURCH
PART LOT 14, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-165-89 be received;
2. THAT the application to amend the Durham Region Official Plan submitted by
Liberty Pentecostal Church, to permit the connection to municipal water at
Highway No. 2 and Martin Road be APPROVED;
3. THAT the applicant be so advised; and
4. THAT the Region of Durham be so advised.
1. BACKGROUND
1.1 On April 26, 1989 the Town of Newcastle Planning and Development
Department was advised by the Region of Durham that an application has
been made by the Liberty Pentecostal Church in Bowmanville. The Church
has requested an amendment to the Durham Region Official Plan to permit
the church to connect to -municipal watermain which had been extended
from the Bowmanville Urban Area to service the municipal arena.

1.2 The Pentecostal Church is currently being serviced by a drilled well
which has recently gone dry. The church has been using bottled water
for domestic uses.
2. OFFICIAL PLAN CONFORMITY
2.1 The subject lands are outside the Bowmanville Urban Area Boundary, the
lands are designated as Major Open Space and Hazard Lands in the Durham
Region Official Plan, places of worship are permitted within this
designation. The applicants proposal to connect to municipal water
outside of the urban area boundary does not conform with the Regional
Official Plan and as a result an application to amend the Plan has been
submitted.
3. AGENCY CIRCULATION
3.1 In accordance with departmental procedures the subject application was
circulated to various departments to obtain comments. In this case, a
limited circulation was completed by the Town. The Town of Newcastle
Public Works and Fire Departments offered no objection to the proposal.
3.2 The Durham Region Planning Department has also completed a circulation
to various agencies. The Regional Health Department has offered no
objection.
3.3 The Regional Works Department have noted that the watermain abutting the
subject property is operating from the pumping facility in Zone 1, which
is serviced from the Bowmanville downtown area, therefore it is
anticipated that the water pressure will be low. However, the Works
Department indicates that when Zone II facilities are constucted for the
Bowmanville North Area the pressure will increase.
The Works Department also notes that the service connection charge and
frontage charge will be $16,197.40

4.1 There is a 400 mm pnaterusain that is located on the north aide of Highway
No. 2 to service the BowmanvllleCommunity Centre. Council is aware
that the Town has expended approximately ¢500v000. to have this
wateroaiu installed. Therefore, it would not be unreasonable to recover
part of this cost from property owners who will gain benefit from it.
We received confirmation from the Region that the amount of frontage
charge to be paid by Pentecostal Church to the Region will be forwarded
to the Town upon receipt.
4.2 Staff have no difficulty in recommending the Official Plan Amendment be
APPROVED to allow the Church to be connected to municipal water oulpI3,.
