SU&JECT: APPLICATION TO AMEND BY-LAW 84-63

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 158 -89 be received;
2. THAT the application to amend By-law 84-63 submitted by Mr. Armond Young
to demolish the existing building and construct a five (5) unit apartment
building be referred back to Staff for a subsequent Report pending receipt
of all outstanding comments; and
3. THAT the applicant and the applicant's agent be so advised.
1. BACKGROUND
1.1 On April 4, 1989 the Town of Newcastle Planning and Development
Department received an application submitted by Mr. Martin Topolie on
behalf of Mr® Armond Young to amend By-law 84-63. The application would
seek to amend the current "Holding-Urban Residential Type One ((H) RI)"
zoning to permit the development of a five (5) unit apartment building
on a .83 hectare parcel

1.2 The subject property currently supports a single family dwelling and an
accessory building, both of which are vacant. The applicant proposes to
demolish these structures and construct the apartment building. The
applicant proposes three, one bedroom apartment units on the second
storey and two, two bedroom units on the ground floor.
2. OFFICIAL PLAN CONFORMITY
2.1 Within the Town of Newcastle Official Plan, the subject property is
designated "Low Density Residential". Residential development shall be
restricted to low and medium density, with an overall density not
exceeding fourteen (14) units per net residential hectare.
2.2 The subject parcel is also located within Neighbourhood lb as shown on
Schedule 8-1 to the Town of Newcastle Official Plan. The population for
this neighbourhood is 1850 persons, however the majority of these lands
are vacant. If the lands are to be developed in accordance with the
prescribed density, the proposal would appear to comply.
3. LOCATION AND SURROUNDING LAND USES
3.1 The subject property is located on the south side of Highway No. 2, east
of Beaver Street, also known as 279 King St., in the Village of
Newcastle.

4. PUBLIC NOTICE AND SUBMISSIONS
4.1 Pursuant to Council's resolution of JoIv 26, 1982 and the zegoizenveute
of the DIaooiog Act the appropriate aigoage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each landowner within the prescribed
distance.
4.2 As of the writing of this report, no written submissions have been

5.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies. The
following departments/agencies in providing cmnx*eota' offered no
objection to the application as filed:
- Tcmvu of Newcastle Fire Department
- Qauazaoka Conservation Authority
5.2 The Town of Newcastle Community Services Department offered no objection
to the proposal, however, request that 5% cash-in-lieu for parkland
dedication be paid to the Town of Newcastle
5.3 The Ministry of Transportation offered no objection to the proposal'
however would require the new building to be setback a minimum of 7.5
metres from the highway property line. In addition, access will be
restricted to the existing access.

6. STAFF COMMENTS

6.1 The applicant has submitted a preliminary site plan, indicating the site
of the new building and the access. The access is situated in a
different location, and in consideration of Ministry of Transportation's
comments, the existing access omot be maintained.

RECOMMENDATIONS
7.1 This Staff report was prepared to facilitate a Public Meeting, pocoonot
to the requirements of the Planning Ant. 0une all outstanding comments
have been received Staff will prepare a subsequent Staff Report.
