THAT Report PD- 151 -89 be received; THAT By- 1aw`U,,179 be\-lifted from the table and be rescinded; and 3`. THAT the attached By -law be passed and be advertised in local newspapers. 1. BACKGROUND 1.1 By -law 88 -179 was presented to Council on November 28, 1988 to prohibit skateboarding in various streets in downtown Bowmanville. The said By -law was tabled by Council until such time the outstanding report on the skateboard issue is received from the Community Services Department. 1.2 The Director of Community Services advised that funds have been allocated in this year's Budget to install a skateboard park in the Town, although the location of this facility has not been finalized at this time. ...2 �yy 41 REPORT N0.: PD-I51-89 PAGE 2 _______________________________________________________________________________ 1,3 Several months have gone by and the By-law Enforcement Officers and the Police Officers are continuously receiving complaints with respect to skateboarding activities in and around the downtown BowmauviIIe area. 1.4 The nature of the complaints are property damages and disruption to the downtown merchants and interference with pedestrians. 1.5 The Police and the Town By-law Officers have encountered difficulties in dealing with these complaints in that there is no municipal by-law in place to allow them to take action. Therefore, Staff have drafted a Skateboard By-law and zeopeotfulll! re000meod Council to enact same. 1.6 On May 29, 1989, Council received a written request from the BovmaovilIe B.I.A. requesting the Town to pass the necessary to ban bicycling and skateboarding on downtown sidewalks. This matter was subsequently referred to Staff for review and a report to the General Purpose and Administration Committee. 2. COMMENTS 2.1 Skateboarding on dovmztcxvu sidewalks and streets has presented numerous problems to pedestrians and to the downtown merchants. To a lesser extent, bicycling on sidewalks also causes similar problems. Staff agree with the concerns of the downtown merchants that these type of activities should not be allowed in the interest of public safety and the protection of private property. 2.2 Accordingly, Staff drafted a by-law to prohibit skateboarding and bicycling on sidewalks on several downtown streets. (refer to Schedule nAx to attached by-law). In addition, skateboarding will be banned on the same streets and within the TovmbaII Square. Council has earlier authorized no skateboarding aigoage be posted on the TovmnbalI Square and the enactment of this By-law will ensure such oiguage is enforceable through the courts. Kotoeff Chief Administrative Officer DN: SKATEB THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW NUMBER 89- being a By -law to regulate the use of skateboards and bicycles in the Town of Newcastle WHEREAS the Council of the Corporation of the Town of Newcastle deems it necessary to regulate the use of skateboards within the limits of the Town of Newcastle; and WHEREAS the Council of the Corporation of the Town of Newcastle, pursuant to the Municipal Act, R.S.O. 1980, Chapter 302, Section 208, Subsection 42, has authority to enact such by -law; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. No person shall ride a skateboard or bicycle on any public sidewalks as identified as per Schedule "A" attached hereto and forming part of this by -law. 2. No person shall ride a skateboard or bicycle on the Division Street municipal parking lot, the Town of Newcastle Fire Department parking lots, or property by the Post Office situated on Temperance Street as identified as per Schedule "A" attached hereto and forming part of this by -law. 3. No person shall ride a skateboard on municipal townhall property on Temperance Street and on any public streets as identified as per Schedule "A" attached hereto and forming part of this By -law. 4. Persons found to be in contravention of any of the provisions of this by -law is guilty of an offence and liable, upon conviction, to a fine not exceeding $2,000.00, exclusive of costs, recoverable under the Provincial Offences Act. This by -law shall come into force and take effect on the date of enactment. MAYOR 599 4 5 CLERK THE CORPORA_ T1(1N OF THE 'DOWN OF NEWCASTLE, By -Law No. 80 =36 Being a by -law to regulate residents owning and using bicycles in the Town of Newcastle WHEREAS, the Council of the - 'Corporation of the Town of Newcastle deems it necessary to regulate residents owning and using bicycles within the limits of the Town of Newcastle, and; WHEREAS, the Council of the Corporation. of the Town of Newcastle, pursuant to the Municipal Act, R.S.O. 1970, Chapter 284, Section 352, Subsection 58, has authority to enact this by -law; .NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. No persons shall ride a bicycle or other vehicle.whatever the motive power along by Schedule or foot pat part of any other place recreation, or upon any sidewalk, or parts of sidewalks as prohibited "A" or ride such bicycle or other vehicle upon a pathway i, used or set apart forthe use of pedestrians and forming highway or bridge, boulevard, park, park lot, garden, or set apart for ornament or embellishment or for public within the limits of the Town of Newcastle% 2. No persons riding a bicycle designated to. carry anything thereon shall do so in such a manner as to prevent or interfere with.full control of such bicycle while.upon any public highway within the Town, of Newcastle. a. No person shall leave a bicycle lying on any public sidewalk, or park, or leave.such bicycle against any window, or in front of or across any door, stairs or entranceway to any building so as to obstruct or interfere with ingress to and from such building. 4. This by -law shall not apply to handicapped or other persons requiring the use of such vehicles as may be necessary for their means of transportation. S. Every person convicted of a breach of any of th.e provisions of this by -law shall be guilty of any offence and shall pay a penalty not exceeding Five Dollars ($5.00) for each offence.' FA 6.
