SUBJECT: REQUEST TO RETAIN SECOND DWELLING FOR RABBITRY OPERATION
MR. AND MRS. VETZAL
PART OF LOT 24, CONCESSION 61 FORMER TOWNSHIP OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 146 -89 be received;
2. THAT Mr. & Mrs. Vetzal be forwarded a copy of Council's decision.
1. BACKGROUND
1.1 Council at their May 29, 1989 meeting in consideration of a written
request submitted by Mr. and Mrs. Vetzal directed that:
"the correspondence dated May 12, 1989, requesting Council's permission
to leave an existing farm house on their property located in Part of Lot
24, Concession 6, former Township of Darlington, for the caretaker of
their rabbits to reside in, be received, and referred to the Planning
Department for review and subsequent report to the General Purpose and
Administration Committee."

2.1 In conjunction with the submission of a building permit application for a
new dwelling permit on the subject Iam]o, a Letter of Undertaking was
authorized by Mc. VetzaI stating that the existing dwelling unit would be
removed when residency of the new dwelling unit was available.
3.2 0r. and Mrs. \etznl wish to retain the second dwelling on their lands,
tnbe occupied by the caretaker of the rabbitry operation.
3.3 Within the Town of Newcastle Comprehensive Zoning By-law 84-63v the
subject lands are located within the "(&-l) Agricultural Exception"
zone. Within this zone one additional single detached dwelling is
permitted provided that such dwelling is used by pecanua employed on the
lot, and provided that the lot is not less than 20 hectares (49.41
acres) in area.
2.4 Mr. and Mrs. Vetzal's property is 10.52 ha (26.002 acres) in size.
2.5 Following Council's meeting of May 29' 1989° Mrs. Vetzml was advised by
Staff that in order to permit the second dwelling to remain on the
subject lands, either a rezoning application or application to the
Committee of Adjustment would be warranted.
2.6 It is Staff's understanding that Mc, and Mrs. VetzaI will be submitting
an application to the Committee of Adjustment to consider their request
to allow the retention of the oeonod dwelling unit.
2.7 Committee and Council will be advised of the Committee of Adjustment
decision through Staff's monitoring reports.
