PD-132-89— FILE #: 89-31_, x -ref 18T 84035) SUBJECT: REZONING APPLICATION - VELTRI AND SON LTD. PART LOT 12, CONCESSION 2, TOWN OF BOWMANVILLE DEV 89-31 (X-REF 18T 84035) I RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-132-89 be received; 2. THAT Application to amend the Town of Newcastle Comprehensive zoning By-law 84-63, as amended, submitted by Veltri and Son Ltd., be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT a copy of Council's decision be forwarded to the interested parties attached hereto. 1. BACKGROUND 1.1 In March, 1989, the Town of Newcastle Planning and Development Department Staff received an application to amend the Town of Newcastle Comprehensive zoning By-law 84-63, as amended. The application was ...2 REPORT NO.: PD-132-89 PAGE 2 submitted by G. M. Sernas and Associates on behalf of Veltri and Son Limited. The application for zoning by-law amendment proposes to change the zone category of a 2.19 ha (5.4 acre) parcel of land in Part Lot 12 Concession 2, Town of Bowmanville from "Agricultural (A)" to an appropriate zone to permit the development of a 24 single family dwelling lot proposed plan of subdivision (18T-84035). (Attachment 2) 1.2 The subdivision application was previously submitted in October of 1984. This application had not been vigourously pursued until now, since servicing was not available and not feasible to extend. We understand developers in the north Bowmanville area are entering into an agreement to pay for the costs of extending water and sanitary sewers which will be available to the proposed subdivision. 1.3 The property is located at the end of High Street. Surrounding land uses include existing residential to the east, Lord Elgin Public School and park to the south and proposed residential to the west, north and east (north of Meadowview Blvd.) 1.4 Staff note that as recently as May 24, a revised plan of subdivision was received for the subject lands, amending the plan from 24, 15m single family dwelling lots to 18, 18m semi-detached/link lots on a cul de sac. (Attachment 3) Staff have numerous concerns with this revision as it does not allow the continued street pattern with the draft approved plan of subdivision abutting to the north or the proposed subdivision abutting to the west. 2. PUBLIC NOTICE AND SUBMISSIONS 2.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, Public Notice was mailed to surrounding landowners within the prescribed distance. ...3 -O'" •, '1 PAGE 3 As of the writing of this report, no written submissions have been received. 3. OFFICIAL PLAN CONFORMITY 3.1 Within the Durham Regional Official Plan the subject property is designated residential within the Bowmanville Major Urban boundaries. The predominant use of land so designated shall be for residential purposes. The application would appear to conform. 3.2 Within the Town of Newcastle Official Plan (Bowmanville Major Urban Area) the subject lands are designated "Low Density Residential ", there also exists a school and park symbol within the vicinity of the property. 3.3 The revised 18 (18 metre) link semi - detached lots would also comply with the Low Density provision in the Official Plan. In addition the park and school designations recognize the existing situation. The application would appear to comply. 4. AGENCY COMMENTS 4.1 The subject rezoning appliation was circulated to numerous agencies and departments for their review and comments. The comments were based on the original application. As of the writing of this report comments remained outstanding from the Regional Public Works Department, Regional Planning Department, the Central Lake Ontario Conservation Authority and Newcastle Hydro. 4.2 In commenting on the proposed rezoning and plan of subdivision the Separate School Board Staff offered no objection to the proposal as submitted. The Public School Board noted they had some concerns and wanted to see fencing constructed around the proposed subdivision, they further noted that they would like to see a sidewalk constructed on High Street. ...4 511 REPORT NO.: PD-132-89 PAGE 4 ------------------------------------------------------------------------------- 4.3 The Town of Newcastle Fire Department Staff noted a concern with the application. The application represents an approximate population increase of 72 persons,based on the original proposal, this may affect the level of service given all the development proposed in the Town. The Town of Newcastle Community Services Department Staff had no objection in principle to the proposal, noting that future residents will be serviced by two (2) neighbourhood parks in the neighbourhood. As a condition of approval a 5% cash-in-lieu of parkland dedication will be required. 4.4 The Town of Newcastle Public Works Department Staff noted no objection in principle subject to several conditions. Aside from Public Works standard conditions, the applicant will be required to bear the cost 1000 of the reconstruction of High Street from Meadowview Blvd. to the north limit of the proposed subdivision. 5. STAFF COMMENTS 5.1 The most recent revision which proposes a cut de sac to originate from the High St./Meadowview Blvd. intersection is not acceptable as it does not accomodate the draft approved road pattern to the north, nor does it allow connection with the proposed street pattern to the west. In this regard, revision to this draft plan similar to the original proposed street pattern (See attachment 2) will be necessary. 5.2 As the purpose of this report is to address the requirement of Public Meeting as required under the Planning Act and in consideration of the comments outstanding, and the nonacceptability of the proposed revised street pattern, Staff is recommending the application be referred back to Staff for further processing. ...5 DI 2 REPORT 00.: PD-132-89 ________________________________ Respectfully submitted, Franklin Wu, yY.C.I.P.
