OF DARLINGTON OUR FILE: DEV 89 -2L RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 125 -89 be received; 2. THAT the application submitted by 669641 Ontario Limited to amend By -law 84 -63, to permit the development of a commercial /retail plaza with apartments on a second storey be referred back to Staff for further processing and pending receipt of all outstanding comments; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On February 28, 1989 the Planning and Development Department received an application to amend By -law 84 -63 submitted by Salvatore Mastrangelo of 669641 Ontario Limited. ...2 518 REPORT NO.: PD- 125 -89 PAGE 3 4. PUBLIC NOTICE AND SUBMISSIONS 4.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 4.2 As of the writing of this report, no written submissions have been received. 5. AGENCY COMMENTS 5.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments /agencies in providing comments offered no objection to the application as filed: - Ontario Hydro - Ministry of Agriculture and Food 5.2 The Town of Newcastle Public Works Department offered no objection to the proposal in principle however, would require the applicant to enter into a site plan agreement with the Town where all conditions would be satisfied financially and otherwise. 5.3 The Town of Newcastle Community Services Department offered no objection to the proposal, however, require the applicant to pay to the Town 50 cash -in -lieu of parkland dedication. 5.4 The Town of Newcastle Fire Department noted a concern with the proposal, indicating that the growth of areas serviced by Station #1 are strained, and it may be difficult to maintain a high level of service to residential areas. 520 ...4 REPORT NO.: PD- 125 -89 PAGE 5 6.2 The preliminary site plan would indicate two (2) access points on King Street, however, the access point is quite close to Taunton Road and it may appear to cause traffic problems and thus interfere with the function of Taunton Road. Without the benefit of comments from the Regional Works Department, Staff will be unable to determine the acceptability of either access point. 6.3 As Council is aware that Staff have been directed recently to finalize the Hamlet Secondary Plan for Hampton, it would be premature to render a decision on this application at this time until the Hamlet Plan is completed. 7. RECOMMENDATIONS The purpose of this Report is to facilitate a Public Meeting in accordance with the Planning Act. In view of several outstanding issues as noted above, Staff would respectfully recommend that the application be referred back to Staff for further processing.
