SUBJECT: REZONING APPLICATION - WILLIAM AND GAYLE WALMSLEY
PART LOT 18, CONCESSIONS 1 & 2, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 122 -89 be received;
2. THAT the application for rezoning submitted by William and Gayle Walmsley
to permit the creation of one (1) non -farm residential lot in the Hamlet of
Maple Grove be DENIED; and
3. THAT the applicants be so advised.
1. BACKGROUND
1.1 On February 17, 1989, the Planning and Development Department received
an application to amend By -law 84 -63, submitted by William and Gayle
Walmsley. The application would seek to amend the current "Agricultural
(A)" zoning to permit the creation of one (1) non -farm residential lot.

2.1 The subject property is located on Maple Grove Road, south of King's
Highway No. 2, being Part Lot 18, Concession 1 and 2, former Township of
Darlington.

five (5) non -farm rural residential lots

one (1) non -farm rural residential lot

3. PUBLIC NOTICE AND SUBMISSIONS
3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements
of the Planning Act the appropriate signage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each landowner within the prescribed
distance.
3.2 As of the writing of this report, no written submissions have been
received.
4. OFFICIAL PLAN CONFORMITY
4.1 The subject property appears to abut development associated with Maple
Grove, a designated Hamlet as defined in Section 10.4.14 of the Regional
Plan. Residential development in Maple Grove is limited to minor
internal infilling and /or minor additions to existing development.
4.2 Staff have reviewed the proposal with respect to existing Official Plan
policies and would note that Section 9 of the Town of Newcastle Official
Plan would require new residential lot sizes within each Hamlet with or
without municipal water systems shall be 0.4 hectares. Staff would note

that the entire parcel is only .6 hectares in lot area. The proposed
lot would only have a lot area of .31 hectares, and with a proposed road
widening, it would appear that the lot area of the proposed lot would be
significantly undersized. Given this, it would appear that the proposal
would not conform to the Town's official Plan policies.
4.3 In addition to the foregoing, Section 9.11 of the Town of Newcastle
official Plan vnyuId require an Engineering Report must be submitted
based on test drilling to confirm the soil cnoditlnma are suitable for a
private waste disposal system; to confirm adequate potable water is
available; and that there will be minimal impact on existing water
supplies. Staff would note that no such report has been submitted to

5. AGENCY COMMENTS
5.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies.
The following departments/agencies in providing comments offered no
objection to the application as filed:
- Town of Newcastle Fire Department
- Regional Health Services Department
- Regional Works Department
5.2 The Town of Newcastle Public Works Department offered no objection to
the proposal however, required a road widening be dedicated to the Town
along Maple Grove Road and that the owner/applicant contribute to the
costs of reconstructing Maple Grove Road in accordance with Town Policy
(45.0 n 141 = $6,345.08).
5.3 The Town of Newcastle Community Services Department offered no
objection, however, requested that the applicant contribute 5%
cash-in-lieu of parkland dedication.

5.4 The Region of Durham noted that Maple Grove is designated as a Hamlet for
infilling in the Durham Regional Official Plan. Residential development
is limited to minor internal infilling and/or minor additions to existing
development. The Region noted that the proposal may be permitted
provided that it is a minor addition to the existing development.
5.5 Staff would also note that a Bell Canada easement traverses the subject
property, therefore consent from Bell Canada is necessary.
6. COMMENTS
6.1 In addition to non compliance with the minimum 0.4 ha lot size as
stipulated in the Official Plan, and the lack of engineering report to
demonstrate the adequacy of water and soil condition, Staff feel that
this type of piece meal development will perpetuate unplanned strip
development. Prior to any development taking place in Maple Grove, it
is prudent that a detailed planning study be undertaken to determine the
feasibility and desirability of hamlet growth. For these reasons, Staff
cannot support this application.
