THAT Report PD- 115 -89 be received; and 2. THAT the application by Powerscreen of Canada Ltd. to rezone the property at Part of Lot 9, Broken Front Concession, former Town of Bowmanville from "Light Industrial (Ml)" to "General Industrial (M2)" be approved and the attached amending by -law be passed; and 3. THAT a copy of the By -law be forwarded to the applicant, his agent, the Region of Durham Planning Department and others as per the circulation requirement of the Planning Act. 1. BACKGROUND: 1.1 On December 2, 1987, Memphis Holdings Ltd. filed a rezoning application on a 1.27 ha property located in Part of Lot 9, Broken Front Concession, former Town of Bowmanville. The purpose of this application is to rezone from the current "Light Industrial (M1)" to "General Industrial (M2)" in order to allow outside storage of equipment. ...2 fi Ij ,J 1.2 The subject property constitutes Lot No. 1 in Plan of Subdivision 18T ®87054 and is subject of a Purchase Agreement between Memphis Holdings and Powerscreen of Canada Ltd. It is noted that the subdivision agreement for this subdivision is in its final stage of preparation and Staff anticipate registration of this subdivision shortly. 1.3 Powerscreen of Canada Ltd. manufactures conveyors for stockpiling of various materials. It currently has manufacturing facilities in Ajax and has been planning for expansion and hence, selected the subject property. Due to the size of the finished equipment, Powerscreen requires outside storage of the finished products which is not permitted within the "ML" zone, and hence the rezoning application. 2. PUBLIC MEETING Public meeting for the rezoning application was held on January 25, 1988. There were no objections or public submissions. 3. OFFICIAL PLAN CONFORMITY The subject property is designated "Industrial" in both the Durham Region Official Plan and in the Town of Newcastle Official Plan. The proposal for outside storage of finished equipment in association with industrial use would appear to conform. Comments from Regional Staff also confirm the above. 4. COMMENTS FROM CIRCULATION 4.1 In accordance with departmental procedures, the rezoning application was circulated to various agencies for comments. The following agencies offered no objection or comment: ® Newcastle Hydro Electric Commission Canadian National Railway ...3 1�I I J Powerscreen would appear to comply with this requirement. 4.3 The Town of Newcastle Public Works Department has no objection to the proposal. However, it recommends several minor changes which will be incorporated in the site plan approval process. 4.4 The Fire Department has no objection but advised that access route and water supply for firefighting purposes must be in place prior to the issuance of a building permit. These matters will be covered in the soon-to-be registered subdivision agreement. 5. COMMENTS 5.1 The purpose of this rezoning application is to allow outside storage equipment. It is noted that the industrial area between Highway No. 401 and the future Lake Road does not allow outside storage. The intent is to create a better aesthetic and appearance along Highway No. 401. Based on the presence of an existing berm on the south side of Highway No. 401 plus the fact that the applicant is providing an 8 foot high solid fence, Staff is satisfied that the outside storage of conveyors are unlikely to be visible from the highway. 5.2 The visibility of the conveyors from the future Lake Road is of some concern. In order to provide some forms of screening, Staff will be requiring the applicant to erect a 6 foot high solid fence on top of an earth berm along Lake Road. Such screening will not completely shield the top portion of the conveyor from public view but nevertheless, will achieve some effective ground screening of any possible unsightly equipment storage. ...4 11111111 6 0 5.3 Given the size of the conveyor, it would be impossible to effectively provide total screening. Staff met with the applicant on several occasions and the applicant understood staff concerns and is willing to co-operate with the Town to provide for fencing and extensive landscaping. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 113" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from "Light Industrial (Ml)" to "General Industrial (M2)" as indicated on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
