SURJECT: REZONING APPLICATION - MARY PIKE
PART LOT 18, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 105 -89 be received; and
2. THAT the rezoning application submitted by Mary Pike to recognize and
permit the continuation of the existing four (4) apartment units in By-
law 84 -63 be referred back to Staff for further processing; and
3. THAT the applicant be so advised.
1. APPLICATION
1.1 On February 6, 1989 the Planning and Development Department received an
application to amend By -law 84 -63, submitted by Mary Pike. The
rezoning application would recognize the existing four (4) apartment
units in one building.

2.1 In February 1987 the applicant applied to the Committee of Adjustment
for relief in lot frontage in order to sever a lot containing the
apartment dwellings.
2.2 The Committee of Adjustment had denied the application since
verification could not be given as to whether or not the four apartment
units were considered legal non - conforming.
2.3 As a result of complaints, the By -law Enforcement Officer had completed
a site inspection and was satisfied at that time, that the dwelling was
only a single family dwelling occupied by eight (8) people with shared
kitchen facilities on the ground floor.
2.4 The applicant, in April 1987 returned to the Committee of Adjustment
for the same proposal. Upon confirmation from the By -law Enforcement
Officer with respect to the status of the dwelling, the Committee
approved the variance, conditional upon the removal of three (3) hydro
metre connections. The disconnection was apparently carried out and
subsequently, the application for consent was granted by the Land
Division Committee.
2.5 In January 1989, the By -law Enforcement Officer investigated the
subject site, again and noted that the four hydro meters were situated
on the dwelling for four (4) separate apartment units. On January 12,
1989 a summons was served to the applicant for contravening the Zoning
By -law. Subsequently, the rezoning application was submitted.
3. LOCATION AND SURROUNDING LAND USES:
3.1 The subject lands are located on the south side of Highway No. 2, east
of Maple Grove Road, being Part Lot 18, Concession 1, former Township
of Darlington.

3.2 The surrounding land uses are as follows:
To the north: non-farm rural residential uses
To the west: non-farm rural residential uses
To the south: farmland
To the east: farmland
4. OFFICIAL PLAN POLICIES
4.1 Within the Durham Region official Plan the subject property is located
within the general vicinity of the designated Hamlet of Maple Grove.
Residential uses are permitted. Development in Maple Grove shall be
restricted to minor internal infilling and/or minor addition to existing
development.
5. PUBLIC NOTICE AND SUBMISSION:
5.1 Pursuant to Council's resolution of July 26, 1982 and the requirements
of the Planning Act the appropriate signage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each landowner within the prescribed
distance.
5.2 As of the writing of this report Staff have received a number of
telephone calls with respect to the proposal. The concerns are
basically with well and septic problems associated with a number of
families living in one building.
6. AGENCY COMMENTS
6.1 In accordance with departmental procedures the appliation was
circulated to obtain comments from other departments and agencies. The
following departments/agencies in providing comments, offered no
objection to the application as filed:
- Town of Newcastle Public Works Department
- Town of Newcastle Fire Department
- Regional Health Services
- Bell Canada

6.3 Staff would note for the Committee's information that comments are
still outstanding from the following agencies:
Ontario Hydro
Central Lake Ontario Conservation Authority.
7 COMMENTS
7.1 This report is prepared for the purpose of facilitating a Public
Meeting in accordance with the Planning Act requirements and Staff is
recommending this application be referred back to Staff for further
processing pending receipt of outstanding comments and input from the
surrounding residents.
