Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -97 -94 be received for information.
1. APPLICATION DETAILS
1.1 Applicant: Dorothy Folkes
1.2 Official Plan Amendment: From "Major Open Space" to an appropriate
designation in order to permit the
creation of two (2) non -farm rural
residential lots.
1.3 Area:
14.63 hectares (36.17 acres)
2. BACKGROUND
2.1 On February 1, 1990, the Planning and Development Department was
advised by the Durham Regional Planning Department of an
application to amend the Durham Regional Official Plan in order to
permit the creation of two (2) non -farm rural residential lots
through the consent process.
2.2 The subject site is a rectangular shaped parcel approximately 14.63
hectares (36.17 acres) in size and is located on the east side of
Gilmore Road approximately 1009 metres (3313 feet) north of
Concession Road 3 but is more formally described as Part Lot 2,
Concession 3, in the former Township of Clarke.

2.3 On September 10, 1990, the Planning and Development Department
forwarded a recommendation of denial through Report PD- 258 -90 to
the Municipal Council. However, Council referred the application
back to staff for further discussions with the applicant.
2.4 Subsequent to a meeting with Mr. Ross Folkes and Mr. Thomas Folkes
on October 12, 1990, staff forwarded an addendum to Report PD -258-
90 to Town Council. The addendum report reaffirmed the Planning
Department's original recommendation of denial. However, on
November 12, 1990, Council resolved to forward a favourable
recommendation to Regional Council.
2.5 Regional Council subsequently denied the Official Plan Amendment
application on July 10, 1991 and the applicant requested the
Minister of Municipal Affairs to refer the application to the
Ontario Municipal Board on August 7, 1991.
2.6 An Ontario Municipal Board hearing relating to the Official Plan
Amendment application is scheduled to commence on Tuesday, October
4, 1994 for one and a half days. Staff will not be attending the
hearing since the professional planning opinion as contained in
Report PD- 258 -90 and in the subsequent addendum report was at
variance with Council's decision. However, Council does have the
option of retaining a private consultant and a solicitor in order
to represent Council at the hearing, although, staff would advise
that funds have not been allocated in the Planning Department
budget for this purpose.
