Subject: REMOVAL OF "HOLDING (H)" SYMBOL TO IMPLEMENT
LAND DIVISION COMMITTEE APPLICATION LD 117/94 - 121/94 INCLUSIVE
PART LOT 33, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -86 -94 be received;
2. THAT Rezoning Application Dev 94 -021 submitted by Jetney Homes
Ltd. requesting the removal of the "Holding (H)" symbol from
the subject lands be APPROVED;
3. THAT the amending By -law attached hereto be forwarded to
Council for approval;
4. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Jetney Homes Ltd.
1.2 Rezoning: Removal of "Holding (H)" provision
1.3 Land Severance:
to create two single family dwelling lots and
three semi - detached /linked lots while
retaining approximately 5100 m2 for future
development.
2. BACKGROUND
2.1 The proponent is attempting to create a total of five lots
fronting on Prestonvale Road, while retaining some interior
lands for future development. Applications LD 117/92 to
121/92 were first heard by the Land Division Committee in June
of 1992. The applications were TABLED a number of times over

the following six month period. Recently however, at a
meeting on June 131 1994, Land Division Committee approved
three of the proposed five lots subject to conditions of
approval, while tabling two due to servicing constraints.
3. COMMENTS
3.1 The subject property is presently zoned "Holding -Urban
Residential Type One ((H)R1). The "Holding (H) " symbol can be
removed upon Council being satisfied that the uses to be
permitted will be adequately serviced, have adequate access,
and will be.used for the purposes intended by the By -law.
3.2 Staff is satisfied that the conditions for removal of the "H"
symbol can be met through the conditions imposed by the Land
Division Committee. All Municipal requirements, financial and
otherwise will be met by the applicant prior to the
Municipality providing the necessary clearance for final
approval of land severance and prior to the issuance of
building permits. Therefore, Staff has no objection to the
removal of the "H" symbol.
3.3 Staff would note for Committee's information that pursuant to
Section 36 of the Planning Act, a By -law Amendment to remove
the "Holding (H)" symbol is not subject to the normal appeal
period afforded to a standard rezoning application, and
accordingly shall be deemed final and binding should Council
grant approval of same.
4. RECOMMENDATION
4.1 In consideration of the comments noted above, Staff would have
no objection to the removal of the "Holding (H) " symbol as
shown on the attached by -law and schedule to permit the
development of three lots.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 94
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former
Town of Newcastle;
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle to
implement application LD 117/92 to LD 121/92, inclusive;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By -law 84 -63 as amended, is hereby further amended by changing the
zone designation from "Holding Urban Residential Type One ((H)R1)" to "Urban
Residential Type One (R1)" zone, as illustrated on the attached Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 36 of the Planning Act.
