1. APPLICATION DETAILS
1.1 Applicant: Taunton Terrace Limited
1.2 Rezoning: Removal of "Holding (H)" provision
1.3 Land Severance:
To create three single family dwelling lots
and a future residential development block.
2. BACKGROUND
2.1 On June 14, 1994, Taunton Terrace Limited submitted an
application to remove the "Holding (H)" symbol. The subject
lands are located on the east side of Foxhunt Trail in
Courtice, legally described as Part Lot 35, Concession 2 in
the former Township of Darlington. ....2

2.2 The removal of the "Holding (H)" symbol would permit
development of single family dwellings on three lots.
2.3 These lots are being created through the land division process
by severing the rear portions of lots fronting onto Darlington
Boulevard according to a lotting scheme approved by the
Planning Department. The lands are subject to Land Division
Committee applications LD 133/94 to LD 136/94 inclusive.
3. STAFF COMONTS
3.1 The lands are currently zoned "Holding - Urban Residential
Type One ((H)R1) ". The "Holding (H)" symbol can be removed
upon Council being satisfied that the uses to be permitted
will be adequately serviced, have adequate access, and will be
used for the purposes intended under the Zoning By -Law.
3.2 With respect to the removal of the "Holding (H) " symbol, Staff
note that three of the severance applications have received
approval by the Land Division Committee subject to conditions
of approval. The applicant had requested that LD 136/94 be
tabled for a period of one year to obtain approval from the
Committee of Adjustment for a reduction in lot frontage
required by the Zoning By -Law. This application was approved
by the Committee and is now final and binding. Subsequently,
the severance application has been rescheduled for July 25,
1994. Staff would not object to this severance subject to
conditions of approval.
3.3 Pursuant to Section 36 of the Planning Act, a Zoning By -Law
Amendment to remove the "Holding (H) " symbol is not subject to
the normal appeal period applicable to standard rezoning
applications, and therefore shall be deemed final and binding
should Council grant its approval.

4. RECOMMENDATION
4.1 In consideration of the comments noted above, Staff would have
no objection to the removal of the "Holding (H) " symbol as
shown on the attached by -law schedule.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 94-
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former
Town of Newcastle.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle to
implement applications LD 133/94 to LD 136/94 inclusive;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By -Law 84 -63, as amended, is hereby further amended by changing
the zone designation from:
"Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)"
as shown on the attached Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 36 of the Planning Act.
