HomeMy WebLinkAboutPD-81-94Meeting: General Purpose and Administration Committee Date: Monday, July 4, 1994 Report #: PD -81 -94 File #: OPA 93 -C /005 OFFICIAL PLAN AMENDMENT 56 BOWMANVILLE WEST Subject: ONTARIO MUNICIPAL BOARD HEARING STATUS REPORT File: OPA 93 -C /005 Res. # 6, By-Law MAIN CENTRAL AREA Recornmendaftns :is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -81 -94 be received; 2. That the Chief Administrative Officer be authorized to engage The Climans Group Inc. to undertake additional work as outlined in Report PD- 81 -94. REPORT 1. On May 25, 1994, the Ontario Municipal Board adjourned the Hearing on various planning matters related to the proposed West Main Central Area and requested that the Municipality "revisit" one element of the proposed secondary plan for this area. Specifically the Board requested that the Municipality examine the relative impact on the existing Main Central Area of a hybrid power centre comprised of a department store, a food store and big box retailers versus the community shopping centre proposed by Markborugh Properties. 2. The Board indicated that it favoured the evidence of the Municipality's retail market expert, Mr. Jeff Climans, over the evidence of other market analysts. Subsequent to discussions with Council, staff and the Municipality's solicitor requested the Mr. Climan's prepare a proposal which addresses the issues outlined by the Board. Mr. Climan's proposal estimates the cost of the additional work including attendance at the September 6, 1994 hearing at $29,250.00 plus G.S.T. Any additional time and expenses incurred for the preparation of further testimony and assistance at the hearing would be additional to this quotation and subject to further authorization. APED R.YNE THIS IS PP-DO RECYCLED PAPER REPORT NO.: PD- -94 PAGE 2 3. Markborough Properties Inc. has reviewed the proposal and has agreed that the costs are reasonable and appropriate. They have provided a letter of undertaking to indemnify the Municipality for the expenses incurred for this additional work. 4. Given the direction provided by the Board in its interim statement of May 25, 1994, it is recommended that The Climans Group Inc. be authorized to undertake the additional retail market analysis required to address the Board's concerns.
