HomeMy WebLinkAboutPD-80-94THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON Subject: LAND EXCHANGE WITH REGION OF DURHAM AND THE DEMOLITION OF SOPER CREEK WATER POLLUTION CONTROL PLANT Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -80 -94 be received; 2. THAT in accordance with the provision of the tri- partite agreement between the Region of Durham, Ontario Hydro and the Municipality of Clarington for the disposition of the Darlington Generation Station Account "A" Reserve fund, the Council of the Municipality of Clarington hereby authorizes the Region to access the said Reserve Fund to pay for the decommissioning, demolition and site rehabilitation of the Soper Creek Water Pollution Control Plant; 3. THAT the Mayor and the Clerk be authorized to execute any document necessary to access the Reserve Fund and to effect the exchange of the Soper Creek Water Pollution Control Plant and the Bowmanville Low Lift Pumping Station sites for the lands east of the Bowmanville Water Supply,Plant; and 4. THAT the Region be advised of Council's decision. REPORT: 1. BACKGROUND: 1.1 On July 19, 1993, Council passed the following resolution: "THAT staff be authorized to take all necessary action to negotiate and finalize an agreement with the Region based on the principle of exchanging Town owned land next to the Port Darlington Pollution Control Plant for the demolition of all structures, and decontamination and conveyance of the Soper Creek Pollution Control Plant site to the Municipality of Clarington." ...2 j 4 APIR PAPER C EC t THISt PRINTENM RECYCLED PAPER REPORT NO.: PD-80-94 PAGE 2 1.2 Subsequent, on May 2, 1994, the Director provided a confidential verbal report updating Council of the negotiations with the Regional staff and advised that the demolition and land exchange may materialize this fall. 2. THE LAND EXCHANGE 2.1 The lands that will be transferred to the Municipality include the Soper Creek Water Pollution Control Plant Site and the Low Lift Pumping Station Site (see Attachment No. 1), totally approximately 5.8 acres of land with the Region retaining several easements for both existing and future sanitary sewers and watermains. 2.2 In exchange, the Municipality will transfer to the Region a 1.68 acre property adjacent to the existing Water Supply Plant (see Attachment No. 2). The Region's land acquisition will facilitate future expansion of the Bowmanville Water Supply Plant or the Port Darlington Water Pollution Control Plant. 2.3 The value of the lands in question have been estimated at equal value by both Regional and Municipal staff and the land swap is considered fair and equity to both parties. 2.4 Prior to the execution of documents for the land exchange, the Municipality requires the following: a) decommissioning, demolition and rehabilitation of the Soper Creek Water Pollution Control Plan site; and b) removal of all equipments and provision of a level concrete floor within the Low Lift Pumping Station. These two matters are addressed as follows. 3. SOPER CREEK WATER POLLUTION CONTROL PLANT As part of the Tri- Partite Agreement between the Municipality of Clarington, the Region of Durham and Ontario Hydro for disposition ...3 JJJ REPORT NO.: PD-80-94 PAGE 3 of the Darlington Nuclear Generating Station Account "A ", a reserve fund was set up in the name of the Municipality of Clarington. The agreement specifically identifies the demolition of the Soper Creek W.P.C.P. as one of the items to be paid for from the fund. Access to the fund is dependant upon the Councils of the Region of Durham and the Municipality of Clarington passing resolutions approving the use of the fund. According to Regional Staff, the estimated cost of decommissioning, demolition and site rehabilitation for the Soper Creek Water Pollution Control Plant is $160,000. 4. LOW LIFT PUMPING STATION The Region staff are agreeable to the Municipality's request to have all surplus equipments inside the building removed and to provide a level concrete floor. The cost of the above works is estimated to be $15,000. which is being borne by the Region independent of the Hydro Reserve Fund. 5. At the time of writing of this Report, Regional staff advised that they will be presenting a report to the Region's Works Committee recommending the land swap as well as seeking authorization from Regional Council for access to the Hydro Reserve Account to carry out the demolition and clean up. 6. Assuming both Councils endorse their respective staff recommendations, tender will be called by the Region immediately and the actual work may commence in the fall. The legal documents to complete the land transaction will take place after the Municipality is satisfied with the conditions of the sites. 7.
