Subject: DELEGATION OF THE POWERS OF THE MINISTER OF MUNICIPAL AFFAIRS TO
THE REGION REGARDING AREA MUNICIPAL OFFICIAL PLANS

ec ®mmend is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -79 -94 be received for information.
REPORT
1. On May 25, 1994, the Ministry of Municipal Affairs advised Regional
Council that the Regional Municipality of Durham would receive
delegated approval powers for area municipal official plan
amendments effective September 1, 1994. This action was
anticipated in light of the updated Durham Regional Official Plan
and the Region's outstanding request to received delegated approval
powers under Sections 4 and 5 of the Planning Act. This completes
the actions necessary to establish a two tier system of planning in
Durham Region.
2. The staff of the area municipalities met with Regional and
provincial staff to review proposed procedures for the processing
of area municipal plans and amendments. Regional staff will be
reporting to Regional Planning Committee shortly on the revised
procedures to accommodate the delegated responsibilities.
3. As part of the procedures, Regional Council will sub - delegate
approval authority to the Commissioner of Planning for "standard"
official plan amendments. A "standard" amendment is defined as one
where the Regional Commissioner's recommendation is in accordance
with the recommendation of the area municipality and where there is
no referral request or objection to the proposed amendment and the

approval of Official Plans. A "complex" amendment and the approval
of Official Plans will be considered by Regional Council.
4. Under the tentative timetable for the new Clarington Official Plan,
staff will bring forward a recommended Official Plan early in the
new year. With the delegation of approval authority to the Region
as of September 1, 1994, the new Clarignton Official Plan will be
approved by Regional Council. Staff have held orientation meetings
with Regional, provincial and agency staff to assist in their
review of the draft Official Plan. With this early consultation
and ongoing coordination with Regional staff, it is anticipated
that the approval of the Clarington Official Plan will be
streamlined.
