HomeMy WebLinkAboutPD-76-94THE CORPORATION OF THE MUNICIPALITY OF CARRINGTON Subject: EXEMPTION FROM PART LOT CONTROL - 290572 ONTARIO LIMITED PART LOT 29, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 88 -116 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -76 -94 be received; 2. THAT the request submitted by 290572 Ontario Limited, for removal of Part Lot Control in respect of Lots 1 to 11 and 13 to 23, inclusive on Phase 2 of the Draft Approved Plan of Subdivision 18T -87092 be APPROVED; 3. THAT the By -law be forwarded to Council following the registration of Phase 2 at the Land Registry Office; and 4. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 Registered Plan of Subdivision 40M -1746, being the first phase, is located in Part Lot 29, Concession 2, in the former Township of Darlington (Courtice). 1.2 In June of 1994, the Planning and Development Department received a request from 290572 Ontario Limited for removal of Part Lot Control in respect of the lots which will be located within the limits of the second phase of development. In light of the up coming summer recess, the request was initiated prior to registration so that a report could be forwarded to Committee and Council in July. Following the registration of Phase 2 of the draft approved plan of subdivision, Staff will forward a By- law to exempt the lands from Section 50(5) of the Planning Act directly to Council. g... ....2 RECYCLED E1111« LR S IS PRIMED CN RECYCLED PAPER REPORT NO. PD-76 -94 PAGE 2 1.3 The removal of Part lot Control would facilitate the construction of semi - detached /link units. This process will enable these lots to be divided and resurveyed after the dwelling foundations are in place. 1.4 For the Committee's information, since the above noted lots are located in a Registered Plan of Subdivision, there is an existing Subdivision Agreement in place to cover the Municipality's financial interest including the payment of parkland dedication and lot levies. 2. STAFF COMMENTS 2.1 Staff would have no objection to the approval of a By -law exemption the subject lands from Part Lot Control. 2.2 Attached hereto is a By -law to exempt the subject lands from Section 50(5) of the Planning Act pursuant to the provisions of Section 50(7) of the Planning Act. This By -law requires the approval of Council and the Regional Municipality of Durham. 2.3 Once all dwellings are erected and conveyed, Staff will prepare another By -law repealing this By -law in order to restore Part Lot Control to the subject lands in accordance with the Planning Act.
