PART LOT 34, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON FILE: 18T -89066 Recommendaftnsis respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -75 -94 be received; 2. THAT the request for removal of Part Lot Control on Lots 2 -6 inclusive on Phase 1 of the draft approved plan of subdivision 18T 89066 be APPROVED; 3. THAT the By -law be forwarded to Council following the registration of Phase 1 at the Land Registry Office; and 4. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 Draft Plan of Subdivision 18T -89066 received draft approval on October 26, 1990. The current Owner of the lands, Reward Building and Development Inc., recently executed with the Municipality the appropriate Subdivision Agreement, and registered same on title. 1.2 The Planning and Development Department in June received a request from Reward Building and Development Inc. for removal of Part Lot Control in respect of lots 2 to 6 inclusive as shown on the yet to be registered 40M Plan. In light of the up coming summer recess, the request was initiated prior to registration of the Plan so that a report could be forwarded to Committee and Council in July. Following the Plans registration, staff would forward a By -law to exempt the lands from Section 50 (5) of the Planning Act directly to Council. RECYCLE° 11111 T 6I PREMEDQ RECYCLED PAPER REPORT NO.: PD -75 -94 PAGE 2 1.3 The removal of Part Lot Control will facilitate the construction of semi - detached /link units on the above noted lots and townhouse units on the above noted blocks. This process will enable these lots to be divided and resurveyed after the dwelling foundations are in place. 1.4 For the Committee's information, the existing Subdivision Agreement in place cover's the Municipality's financial interest including the payment of parkland dedication and lot levies. 2. STAFF COMMENTS 2.1 Staff would have no objection to the approval of a By -law exempting the subject lands from Part Lot Control. 2.2 Attached hereto is a By -law to exempt the subject lands from Section 50 (5) of the Planning Act pursuant to the provisions of Section 50 (7) of the Planning Act. This By -law requires the approval of Council and the Regional Municipality of Durham. 2.3 Once all the dwellings are erected and conveyed, Staff will prepare another By -law repealing this By -law in order to restore Part Lot Control to the subject lands in accordance with the Planning Act. 2.4 Following the registration of the 40M Plan pertaining to the draft approved plan of subdivision 18T- 89066, Staff will forward a By -law to exempt the subject lands from Section 50 (5) of the Planning Act directly to Council. j22 REPORT NO.: PD- 75 -94 PAGE 3 Respectfully submitted, , o�,-Q LK.
