Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF JULY 6, JULY 20 AND AUGUST 17, 1995
FILES: A95/024 TO A95/030, INCLUSIVE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -98 -95 be received;
2. THAT Council concur with the decisions of the Committee of
Adjustment made on July 7, July 20 and August 17, 1995; and
3. THAT Staff be authorized to appear before the Ontario
Municipal Board to defend the decision of the Committee of
Adjustment in the event of an appeal.
1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990,
all applications received by the Municipality for minor
variance are scheduled to be heard within 30 days of being
received by the Secretary Treasurer. The Committee heard a
total of seven (7) applications during the three (3) meetings,
denying one and approving six.
1.2 Application A95/024 was to permit the expansion to an existing
non - complying deck by reducing the rear yard setback to 0.3
metres and the side yards to 0.05 metres and 0.3 metres. The
effect of the expansion would result in a deck covering the
majority of the rear yard. The application was not supported
by Staff as the variance was not considered minor in nature or
desirable and was DENIED by the Committee.

1.3 The balance of the applications were approved as applied for,
although in some situations conditions were imposed. Details
of each application and Committee's decision is appended to
the report.
1.4 Staff have reviewed the Committee's decision with respect to
the above - referenced applications and are satisfied that they
conform to the general intent of the Official Plan and Zoning
By -law and are minor in nature.
1.5 Council's concurrence with the Committee of Adjustment
decision is required in order to afford Staff's official
status before the Ontario Municipal Board in the event of an
appeal of the decision of the Committee of Adjustment.
