Subject: REZONING APPLICATION - CLARINGTON DEVELOPMENT CORPORATION

PART LOT 30, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -90 -95 be received;
2. THAT application to amend Comprehensive Zoning By -law 84 -63,
as amended, of the former Town of Newcastle submitted by D. G.
Biddle & Associates Limited on behalf of Clarington
Development Corporation be referred back to Staff for further
processing; and
3. THAT all interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Clarington Development Corporation
1.2 Agent: D. G. Biddle & Associates Limited
1.3 Rezoning Application:
from "Agricultural (A)" to permit the development of a
proposed plan of subdivision.
1.4 Official Plan Amendment:
to expand the Courtice Urban Area boundary and permit 142
residential units.
1.5 Neighbourhood Plan Amendment:
to expand the Courtice South, Neighbourhood Plan boundary
and designate a road system. ....2

1.6 Proposed Plan of Subdivision:
for a total of 142 units consisting of 56 single family
units, 38 semi - detached /link units, 48 townhouse units
and various blocks for school, future roads and future
development
1.7 Land Area: 7.94 hectares (19.6 acres)
2. LOCATION
2.1 The subject property is located south of Avondale Drive and
east of Trulls Road in Courtice.
3. BACKGROUND
3.1 The applicant has filed a total of four applications, three to
the Municipality and one to the Region of Durham. The One
application to the Region is for Draft Approval of a Proposed
Plan of Subdivision. The Official Plan Amendment application
proposes to expand the Courtice Urban Area boundary to include
the subject lands. The Neighbourhood Plan Amendment
application is also for expansion to the Neighbourhood Plan
boundary and land uses including the detailing of road
locations. The Zoning By -law Amendment would permit the
development of the 142 units in the various zone categories.
4 EXISTING AND SURROUNDING USES
4.1 The existing site is currently vacant and is being used for
temporary storage of top soil for the development of the lands
to the north.
4.2 Surrounding land uses are as follows:
South: existing church and agricultural lands
East: agricultural lands
North: residential development
West: residential and vacant lands subject to
development applications ....3

5 PUBLIC MEETING AND RESPONSE
5.1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject
lands. In addition the appropriate notice was mailed to each
landowner and tenant within the 120 metre prescribed distance.
As of the writing of this report, no letters or enquiries
objecting to the applications have been received.
6 OFFICIAL PLAN POLICIES
6.1 Within the Durham Regional Official Plan the subject property
is designated "Living Area ". Said designation shall permit the
development of communities with defined boundaries,
incorporating the widest possible variety of housing types,
sizes and tenure. The proposal appears to conform.
6.2 The subject lands are beyond the Courtice Urban area boundary
as identified in the former Town of Newcastle Official Plan,
hence the application for Official Plan Amendment.
7 ZONING
7.1 The current zoning on the subject property is "Agricultural
(A) ". Said zone would not permit the development of the
proposed Plan of Subdivision.
8 AGENCY COMMENTS
8.1 In accordance with departmental procedure the subject
application was circulated to a number of agencies and
departments for comment. To date comments remain outstanding
from a number of agencies including Clarington Community
Services and Public works Departments, the Conservation
Authority, the Separate School Board, Regional Planning
Department and the Ministry of Natural Resources.

8.2 The Fire Department, Bell Canada and Ontario Hydro have all
advised they have no objection to further processing of the
applications filed.
8.3 The Ministry of Culture, Tourism and Recreation has provided
comments advising the subject property has a medium potential
for causing impacts to cultural heritage resources.
Consequently the Ministry has recommended that as a condition
of approval a cultural heritage resource assessment take place
prior to any development of the property.
8.4 Regional Works Staff have advised that both water and sanitary
sewer are available to the property by extension from
Yorkville Drive. Regional Works Staff note that provision for
a sanitary connection to the existing church located south of
this site should be made. A 5.18 metre road widening and 0.3
metre reserve are requested across the total frontage of the
property on Trulls Road.
8.5 The Public School Board has advised that this development will
yield approximately 46 students. Although a Public Elementary
School site is planned in the development immediately to the
north, it will not be available for occupancy until September
of 1997. Prior to September 1997 students generated from this
development would have to attend Courtice South Public School,
which is over capacity with 9 portables on site. The School
Board wishes to ensure that this development is phased to
assure that the new school planned for this area is in place
for students generated by this development.
9 STAFF COMMENTS
9.1 The proponent has filed four development applications for the
subject property to permit the development of 142 residential
units. Currently the lands are outside of the Courtice Urban

Area boundary. As such, this application is subject to
Council resolution of January 1992, which placed an
administrative freeze on processing of applications in the
urban expansion areas added by the 1991 Durham Regional
Official Plan.
9.2 Staff have scheduled the Public Meeting as required for the
Zoning By -law Amendment and have circulated the application to
the appropriate agencies. However, Staff do not expect to
prepare a subsequent report on the subject lands until such
time as the Clarington Official Plan has been approved by
Council.
9.3 At this time the applicant is proposing an overall gross
residential density of 17.9 units per hectare. This would
appear to be higher than that proposed in the Draft Clarington
Official Plan. As well the Plan of Subdivision is proposing
two Blocks (84 and 85) which are suggested to be rear lanes.
To date, the Municipality has not taken a definitive position
on this design feature for new residential developments.
10 CONCLUSION
10.1 The purpose of this report is to facilitate the Public meeting
as required by the Planning Act, to provide Committee and
Council with some background on the application submitted and
for Staff to indicate issues or area of concern regarding the
subject application. It is recommend the application be
referred back to Staff for further processing and subsequent
report upon resolution of the Clarington Official Plan and
receipt of all outstanding comments.
