THAT Report PD -82 -95 be received; 2. THAT the request of the Local Architectural Conservation Advisory Committee to designate as a Historical Structure, the property listed on Attachment No. 1 be approved; 3. THAT the Clerk prepare the required notice of intent pursuant to the provisions of the Ontario Heritage Act and report back to Council following the prescribed notification period; and 4. THAT the Local Architectural Conservation Advisory Committee be advised of Council's decision. 1. BACKGROUND 1.1 The Planning Deartment has received a copy of a request submitted to the Local Architectural Conservation Advisory Committee (L.A.C.A.C.) to designate the John Rutledge house at 2656 Concession Road 4, Part Lot 10, Concession 4, former Township of Darlington. as having historic and /or architectural value or interest. The subject property is described in Attachment No. 1. The house has been identified in the former Town of Newcastle's L.A.C.A.C. inventory as being a structure of "Primary" heritage value with an inventory number assigned at H063. 599 31 REPORT NO.: PD -82 -95 PAGE 2 1.2 The Ontario Heritage Act empowers a municipality to pass a by- law designating a house to be of historic and /or architectural value or interest. The Act stipulates that the owner of structure so designated can not alter the structure where such alteration is likely to affect the reason for the designation, without the written consent of Council. Council is required to consider any application for alteration of a designated property in consultation with the L.A.C.A.C. 1.3 The Chairperson of the L.A.C.A.C. has advised that the designation request has been made in response to a request submitted by the respective property owner. The L.A.C.A.C. has provided the property owner with relevant information related to the designation of the property, including the restrictions placed on the property as a result of designation. 2. COMMENTS 2.1 Staff have reviewed the property indicated on Attachment No. 1, in terms of its Official Plan and Zoning By -law designations. In addition, external visual inspections of the property were conducted. Staff has no objection to designating the structure pursuant to the Ontario Heritage Act as having historical and /or architectural significance. 2.2 It is therefore recommended that the Clerk prepare, send and publish the required notice of intent pursuant to Section 29 of the Ontario Heritage Act and report back to Council following the prescribed notification period. 599 32 REPORT NO.: PD -82 -95 PAGE 3 Respectfully submitted, Reviewed by, Mrs. Ayesha Richards 2656 Concession Road 4 R.R.#5 Bowmanville, Ontario. Attachment #lA Concession John Rutledge House •._.. Part Lot 10, Concession 4, former Township of Darlington Built for John Rutledge, circa 1860, this structure was designed with Georgian symmetry and shows evidence of the Greek Revival period in its returned eaves and distinctive lintels. The "eye- brow" window set over the glazed porch is an architectural feature which is found in only two structures in Darlington Township. The following exterior and interior features are recommended for designation under Part IV of the Ontario Heritage Act: Exterior: • 6 over 6 original glazed windows • glazed porch • paired brackets 0 returned eaves • 4 over 4 double hung windows • eye -brow window • contrasting buff brick • stone foundation • Liverpool bond, english bond and common bond brick work Interior: • dining room hand - grained doors and frames o staircase with mahogany newel cage, oak hand rails and spindles • parlour fireplace mantel and surround • built in china cabinet • coloured glass of front door sidelights and transom • original pine floors • pine servants staircase el rN 7 A a `, � J L �w z 0 V) V) w U z 0 U
