Date: Monday, July 10 1995 Res. #�'� Report #:PD -78 -95 File #: PLN 30.1 By -law Subject: REPEAL OF ARCHITECTURAL CONTROL BY -LAW 86 -145 FILE: PLN 30.1 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -78 -95 be received; and 2. THAT the By -law attached hereto repealing By -law 86 -145 be forwarded to Council for approval. 1. Council in 1986, in anticipation of the number of Plans of Subdivision which would be proceeding through to the development stage, deemed it appropriate to adopt minimum standards for new housing development within the urban areas of the former Town of Newcastle. As a result, the following policies were adopted through the passage of By -law 86 -145: 111. Prior to the issuance of building permits, for new housing development within the urban areas of Bowmanville, Courtice, and Newcastle Village, the Director of Planning or his designate shall approve the conceptual design of such dwellings. 2. The Director of Planning shall not authorize the issuance of building permits unless the exterior construction of such dwellings is comprised of at least 40% masonry eg. brick, stone or other earthen product, but excluding stucco and /or concrete block, with the remainder of the exterior construction being comprised of finished wood, vinyl or aluminum siding, but excluding plywood, particle board or other similar wood sheeting material. 6 REPORT NO.: PD- 78 -95 PAGE 2 3. The Town of Newcastle shall require that no more than a total of three (3) adjacent dwellings utilize the same building elevation in order to ensure a variety of building elevations." 2. As Committee may recall, the Municipality has been approached over the past few years by the Development Industry, requesting the Municipality's consideration and modification to the core Subdivision Agreement. Staff, in turn, has attempted to improve and update the current agreement to reflect the wishes of Council as well as the changing trends and construction techniques and building materials used by the development industry today. 3. Included within the last round of revisions considered and made to the core agreement were changes to the Architectural Control Standards contained in Schedule "W ". This schedule, originally inserted into the core agreement in 1988, was endorsed by the Home Builders Association as sufficient in providing the Development Industry with the necessary guidance and flexibility for their new home designs. 4. The Architectural Control By -law passed in 1986 provided a good foundation for the Municipality at a time where there was no provision in the subdivision agreement to deal with architectural control. However, through the introduction of "Schedule W" - Architectural Control Standards" within the Municipality's core agreement, the need to implement the 1986 Architectural Control By -law is considered redundant. It is for the above reasons that staff feels that By -law 86 -145 has out lived its usefulness and recommends that it be repealed in its entirety. 5. By -law 86 -145 should have been appealed sometime ago except for the fact that staff would like to take some time to evaluate the effectivenss of the Architectural Control Standards in the core subdivision agreement. We are now REPORT NO.: PD- 78 -95 PAGE 3 satisfied that the control mechanism through the subdivision agreement is more than adequate. 6. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it appropriate to repeal By -law 86 -145 in consideration of the requirements and provisions contained in the Municipality's Standard Subdivision Agreement, Schedule "W ", entitled Architectural Control Standards, for all new housing developments within the Municipality; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington hereby enacts as follows: 1. By -law 86 -145 is hereby repealed. BY -LAW read a first time this day of 1995. BY -LAW read a second time this day of 1995. BY -LAW read a third time and finally passed this day of 1995. MAYOR CLERK THE CORPORATION OF THE TOWN OF NEWCASTLE i BY -LAW NUMBER 86- 145 being a By -law to adopt a policy in respect of Architectural Control for new housing developments within the urban areas of the Town of Newcastle. Whereas the Council of the Corporation of the Town of Newcastle deems it advisable to adopt a minimum standard for new housing development within the urban areas of the Town of Newcastle; The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT a policy in respect of Architectural Control be established in the Town of Newcastle and that said policy shall be as provided in Schedule "A" attached to this By -law.
