THAT Report PD -77 -95 be received; 2. THAT the Plan of Subdivision 18T91006 draft approved and dated June 1, 1992 be amended as per Attachment No. 2 to this Report; 3. THAT a copy of this Report and Council's decision be forwarded to the Region of Durham Planning Department for approval; and 4. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 On June 1, 1992 Plan of Subdivision (18T91006) was granted draft approval from the Region of Durham Planning Department. This plan of subdivision has 15 single detached dwellings, 26 semi - detached units, and 22 townhouse units for a total of 63 residential units. Attachment #1 shows the location of the subdivision. This subdivision has not proceeded any further beyond draft approval. A subdivision agreement has not been entered into and the lands remain vacant. 2 PURPOSE 2.1 The purpose of this report is to seek Council's approval for an amendment to draft approval of 18T91006 to provide for a future road connection to the abutting easterly land parcel which the Municipality has recently received an application for a plan of subdivision (18T95029). ....2 559 REPORT--AO. PD-77-95 PAGE 2 2.2 The Official Plan for the former Town of Newcastle identifies a collector road joining Trulls and Courtice Roads as does the draft Clarington Official Plan. At the time Staff were reviewing this plan of subdivision, it was confirmed that a road is unlikely to be put through at the vicinity of Lot 1 because there is a Development Agreement which called for development of apartments on the abutting easterly parcel. As a result, Staff agreed to allow a residential lot and a walkway to replace the extension of the collector road. 2.3 Recently the ownership of the easterly lands changed and the new owner has indicated that he is not interested in pursuing the original agreement to develop the lands for apartments. In fact, the new owner has submitted a draft plan of subdivision proposing a east -west road to connect westerly through Lot 1 of the subdivision in question. (See Report PD -70 -95 on the same agenda) 2.4 In order to ensure the proposed road will connect the two subdivisions, it is imperative that Lot 1 in Plan of Subdivision 18T91006 be removed and be set aside as a Block for a future road. This proposed change would ensure the east -west road will be provided through the subdivision in conformity with the Official Plan. 3. PROPOSED AMENDMENT 3.1 For the purposes of the Amendment to the draft approved plan, Lot 1 and the walkway block will be deleted and are to be replaced by a new Block 36 for the required road allowance. Lot 2 will be adjusted to increase the frontage to 15 metres for a corner lot. 3.2 If at such time as it is determined that Block 36 is not needed for road purposes, the Municipality will endorse the original block and lot layout previously approved. ....3 X60 REPORT NO. COMMENTS 5.1 Approval of this amendment is necessary in order to provide the Municipality with the ability to provide a proper transportation network that would meet the future needs of the residents. 5.2 We have contacted the applicant with respect to the proposed amendment and were advised that they are not in agreement to the proposed change. Staff would like to advise Council that the Municipality has the authority to seek changes to any draft approved plan of subdivision. In this situation, it is apparent that circumstances noted in this report necessitate this change for the public interest. Respectfully submitted, i t Franklin Wu, M.C.I.P. THAT Condition #1 of the Conditions of Draft Approval for Plan of Subdivision 18T91006, dated June 1, 1992 be amended as per the attached red line sketch to state as follows: "That this approval applies to draft plan of subdivision 18T91006 prepared by G.M.Sernas and Associates Ltd., identified as project number 90174 revised and dated April 1992 which illustrates 14 lots for single detached dwelling units, 26 semi - detached dwelling units, 22 townhouse units, a block for future development, a block for park purposes, Block 36 for future road allowance, and various blocks for reserve for road widening." 2.
