THAT Report PD -50 -95 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on April 27, 1995; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee heard five applications at the April 27, 1995 meeting APPROVING four and TABLING one. 1.2 Details of each application and the Committee of Adjustment decisions are included in the attachments. A 95/015 was tabled to the next available meeting to allow the recirculation of an amended application. This property is presently undergoing a severance and a minor variance is necessary to facilitate this. The applicant is applying for relief from the by -law to allow an interior side yard setback of 0.452 metres instead of the required 1.2 metres. This is . 599 3 a further reduction that was originally applied for as the of the i demolition applicant has been hampered during the demol and the structure by the interior design of the building manner in which it was erected. 1.3 Staff have reviewed the Committee's decision atisfied that they the above - referenced applications and are s conform to the general intent of the Official Plan and the Zoning By -law. 1.4 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's eveoff flan status before the Ontario Municipal Board in appeal of the decision of the Committee of Adjustment.
