HomeMy WebLinkAboutPD-22-95THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON E Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF FEBRUARY 16, 1995 FILE: A94/0541 A95/001 AND A95/002 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -22 -95 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on February 16, 1995; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee heard two (2) new applications as well as one which was previously TABLED. 1.2 At the meeting, application A94/054, previously TABLED in December was withdrawn by the applicant. The two new applications were both APPROVED. 1.3 Application A95/001, was to allow the applicant to develop a mini -putt course having no parking spaces where the Zoning By- law requires one to be provided. The mini -putt is to be established in the rear yard of the existing convenience store use on Second Street. A number of neighbouring residents attended the meeting in opposition to the application. ....2 5118 W8 PRIMER Q4 REM LED PAPER REPORT NO.: PD -22 -95 PAGE 2 1.4 Application A95/002 was to permit a reduction in the size of apartment units for one of the four buildings permitted on the subject property. The applicant advised that the reduction in unit size is to facilitate an all senior citizen's building which would have increased amenity area. 1.5 Staff have reviewed the Committee's decision with respect to it's decisions and are satisfied that they conform to the general intent of the Official Plan and the Zoning By -law. 1.6 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment.
