Report #: PD- 134 -94 Fiie #: A94/038, A94/039, A94/041 to A94 /vt6avI1CtU8TVE--®° Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF OCTOBER 20 AND NOVEMBER 3, 1994 FILE: A94/0381 A94/039, A94/041 to A94/050 INCLUSIVE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 134 -94 be received; 2. THAT Council concur with the decision of the Committee of Adjustment made on October 20 and November 3, 1994; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee heard a total of twelve (12) applications during the two meetings. Three applications were tabled from the October 20, 1994 meeting to the November 3, 1994 meeting. All the applications were approved at the second meeting. Details of each application and decision of the Committee is attached for information. 1.2 Application A 94/038 and A 94/039 were TABLED by the Committee to the November 3, 1994 meeting as a result of concerns with the circulation. They were subsequently approved at the second meeting to allow the creation of a second lot in the Bond Head area with a deficient lot frontage. ....2 PIE D PAP E�nC ECy CLE THIS IS PRIMED OH RECYCLED PAPER ■ ■O• ■D PAGE 2 1.3 Application A94/40 was TABLED from the October 20th. meeting to November 3, 1994, at the applicant's request. The application was tabled to allow the applicant opportunity to address the concerns of the Public Works Department. The Public Works Department was agreeable to relocating the placement of the future sidewalk on Apple Blossom Blvd. This in turn provided sufficient depth for a parking space between the sidewalk and the garage, although not completely on the property. 1.4 Staff have reviewed the Committee's decision and are satisfied that they conform to the general intent of the Official Plan and the Zoning By -law are minor in nature and desirable. 1.5 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment. The lot which accommodates the building, was part of a Crown grant to Captain John McGill, who sold it in 1801 to Robert Baldwin, one of Clarke Township's earliest settlers. The oldest section of the frame house dates from the 1830s and it is located behind a two storey Edwardian addition, which was constructed by a Newcastle master carpenter named Pool in the early 1900s. Significant to the Village of Newcastle, the following architectural features are recommended for designation under Part IV of the Ontario Heritage Act: Exterior: • the frame facade • the two storey L- shaped verandah • the original 2 over 2 sash windows • the two 20 paned windows and large • the two main wooden doors, one in the 1900s portion Interior: and storms paned windows with storms the 1830s portion and one from • the staircase with hand - crafted bannister leading to the kitchen • the main staircase of wide - grained Virginia chestnut • the original pine and oak floors through -out • the original wood trims, mouldings and doors • the two wood and glass -paned pocket doors • the fireplace surrounds and mantles with built in caste and copper burning units _7rw_u J J W 7 — a h a a_ a t? v Y] Z O W V Z O V V Z V ATTACHMENT 5A 4672 HIGHWAY NO. PART LOT 5, CONCESSION 1, FORMER TOWNSHIP OF CLARKE Known as the George Beard House, this structure was built sometime around 1856, by either Joshua George Beard, a former mayor of Toronto, or Joseph Thompson, who purchased the property in 1854. It has been constructed in sections of rubblestone and coursed fieldstone and is representative of the former Township of Clarke's stone farm houses. As such, the following exterior features are recommended for designation under Part IV of the Ontario Heritage Act: Exterior: • the coursed fieldstone sides and front facade • the rubblestone back with its summer kitchen • the original front door • the rectangular sidelights and transom • the 6 over 6 sash windows with original glazing • the cornice moulding and eaves returns • the stone voussoirs over the windows and front entrance The following interior features are to be noted but not designated at this time: • the front and back staircases • the wainscotting of the summer kitchen • the rough plaster over lathe on the summer kitchen ceiling • the original iron ceiling hooks • the original wood trim throughout • the pine flooring • the interior doors LOT 8 7 6 I (CONCESSION IRo 3 r,. � -� od LOT 5 I L 544 c VNI Z O W V Z O V
