THAT Report PD- 113 -94 be received; 2. THAT the Zoning Amendment application submitted by George West, requesting the removal of the "Holding (H)" symbol from the subject lands within part Lot 33, Concession 2, of the former Township of Darlington be APPROVED; 3. THAT the attached amendment to By -law 84 -63 be APPROVED; and 4. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: 1.2 Rezoning: 1.3 Land Severance: 1.4 Area: George West From "(Holding) Urban Residential Type One (H)R1" to "Urban Residential Type One (R1) Zone" to create one residential lot fronting on Renwick St. .065 hectares 2. LOCATION 2.1 The subject lands are located in Part Lot 33, Concession 2, former Township of Darlington. The lands have frontage on Renwick St. and presently form the southwest part of 2640 Prestonvale Rd. (See Attachment #1). ....2 Mal REPORT NO. PD- 113 -94 PAGE 2 3. BACKGROUND 3.1 On July 28, 1994, the Planning and Development Department received an application, submitted by George West, requesting the removal of the "Holding (H)" symbol from the subject lands. 3.2 Staff note that the subject lands are concurrently subject to a land severance application. The Land Division Committee is being asked to consider the creation of one new residential lot, subject to various conditions of approval. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: Vacant 4.2 Surrounding Uses: East - residential West - residential North - residential South - residential S. STAFF COMMENTS 5.1 The subject property is presently zoned "Holding - Urban Residential Type One ((H)R1) ". The "Holding (H)" symbol may be removed by Council, upon Council being satisfied that the uses to be permitted will be adequately serviced, have the adequate access and will be used for the purposes intended by the by -law. The parcel is proposed to be created by consent and as a condition of such an application, the requirements of the Municipality of Clarington to be fulfilled include conformity to the Zoning By -law. 5.2 In reviewing this application, Staff is satisfied that the conditions of removal of the "Holding (H)" symbol will be met. ....3 597 REPORT NO. PD- 113 -94 PAGE 3 All Municipal requirements, financial and otherwise, will be met by the applicant prior to the Municipality providing the necessary clearance for final approval of land severance and prior to the issuance of a building permit. 6. RECOMMENDATION 6.1 In consideration of the comments noted above, Staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached By -law and Schedule to permit the development of one residential lot. Stockwell Chief Administrative Officer r% SL�L �II THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY -LAW NUMBER 94- being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former Town of Newcastle. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle to implement DEV 94 -041. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "4" to By -law 84 -63 as amended, is hereby further amended by changing the zone designation from: "Holding Urban Residential Type One ((H)Rl)" to "Urban Residential Type One (R1)" as illustrated on the attached Schedule "A" hereto. 2. Schedule "A' attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing hereof, subject to the provisions of Section 36 of the Planning Act.
