Subject: REZONING APPLICATION - TEMPORARY USE BY -LAW
MOSPORT PARK INC.
PART OF LOTS 33, 34, 35, CONCESSION 91 FORMER TOWNSHIP OF CLARKE

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -30 -94 be received;
2. THAT the application to amend Comprehensive By -law 84 -63 of the
former Town of Newcastle submitted by Mosport Park Inc. be referred
back to Staff for further processing;
3. THAT a copy of Committee's and Council's decision be forwarded to
the interested parties attached hereto.
1. APPLICATION DETAILS
1.1 Applicant:
Mosport Park Inc.
1.2 Rezoning:
From "Agricultural Exception (A -21)" to a
zoning category that would allow in addition
to the permitted "Motor Vehicle Race Track ",
the temporary use of certain portions of
Mosport Park land for:
1) outdoor music festivals, concerts and
entertainment events with ancillary or
accessory uses, for up to 50,000 persons per
day for a period of three (3) years; and
2) camping facilities and ancillary or
accessory uses in conjunction with outdoor
music festivals concerts and entertainment
events for up to..25',000 persons per night for
a period of, one year.

2. LOCATION
2.1 The subject property is located in part of Lots 33, 34 and 35,
Concession 9, former Township of Clarke, bounded to the north by
Concession Road Number 10, to the east by Mosport Road, to the west
by the Darlington- Clarke Townline Road and to the south by
Concession Road Number 9.
3. EXISTING AND SURROUNDING USES
3.1 Existing Uses: Motor Vehicle Race Track and associated
accessory uses.
3.2 Surrounding Uses: North - Agricultural /Rural
West - Agricultural /Rural
South - Agricultural /Rural
East - Agricultural /Rural
4. OFFICIAL PLAN POLICIES
4.1 Within the Ministry approved 1991 Durham Regional Official Plan the
subject lands are located within the "Major Open Space System - Oak
Ridges Moraine" designation. Lands so designated shall be used
predominantly for conservation, recreation, reforestation,
agricultural and farm related uses. Staff note for the Committee's
information that the designation of said lands has been referred to
the Ontario Municipal Board by the applicant. Apparently, the
referral request is the result of the applicant's wishes in having
a "Tourist Activity Node" added to the Land Use designation.
S. PUBLIC MEETING AND SUBMISSIONS
5.1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands.
In addition, the appropriate notice was mailed to each landowner
and tenant within the 120 metre prescribed distance.
Staff, in addition, placed the notice of the Public Meeting in the
local newspapers. As of the writing of this report, there are no
written comments or objections. However, several individuals

visited the Planning Department to inquire as to the nature of the
application.
6. STAFF COMMENTS
6.1 Throughout the last few years, Mosport Park and the Municipality
have been involved in law suits related to the use of land at
Mosport Park. In an attempt not to engage in further costly legal
battle, both parties agree to negotiate for a possible settlement.
6.2 In consideration of the terms of settlement, Council agreed to
consider an application by Mosport Park Inc. to amend the Zoning
By -law to allow the temporary use of certain portions of the
Mosport Park lands for outdoor music festival and camping
facilities.
6.3 Prior to any decision by Council on the rezoning application, the
Planning Act requires a public meeting to be held. A subsequent
report will be brought forward to allow the dispositions of the
rezoning application by Council.

Subject:Mosport Park
Dear Committee
My name is Gary Baker and I live at 5216 Darlington-Clarke Townline
Road.My house borders Lot 35 on the west side of the townline road.
My house is directly west of the recently built oval track.
I am opposed to the amendment changes for part "all and part "b"
for the following reasons.
1) EXTREMELY LOUD NOISE
The oval track runs every Saturday night from the middle of May to
the middle of September The noise from the track stops any outside
activity during the lovely Saturday nights for the entire summer
months.The noise also stops us from entertaining guests outside our
home on the night of the race, as practice for the race begins
about 5:30 p.m. and the race begins at 7:00 p.m. and continues
until approximately 11: 00 p.m.. The noise is so loud that two people
standing outside the house cannot carry on a conversation.
2) INVASION OF PRIVACY
I have two children, ages 8 and 10 and they are forced to keep
their windows shut in order for them to go sleep before the race
ends® I must close the windows just to here the television set in
my own home.
They have had overnight camping in lot 35 already where they park
their big motor homes long -the townline road directly opposite my
house. I then had to rush my children from my own front lawn as
they are forced to watch people going to the washroom behind their
motor homes facing my front lawn.This is just not right! I can hear
-the sound of the generates from the motor homes running all night®
3) GARBAGE
I am sick in tired of picking up garbage off my front lawn after
each overnight camping event.I do not need any of their garbage
blowing over after the people leave.
4) Damages
Mosport has always created crowds around my area® I have lived at
this farm residence for 34 years and every year I have people
-walking across my property to get to Mosport.11ve had people cut my
fences, dig my potatoe.s and pick any corn depending on what Time of
year it is. The po]Jce do patrol our road during the larger races
but leave before the race is over -I've put up with increased (lust
on our sideroad during the races as more traffic travels up and
down our road. I must keep -a close eye on my children during the
increased travel times because of the real possibility of something
criminal happening to them.
5) SCARING ANIMALS
This farm has been in the family for over 55 years and the property
has been farmed for the entire period. Last year I finally stopped
keeping cattle on the farm when I came home after a weekend visit
with the in-laws to discover the fence keeping the cattle in had
been cut and the cattle were gone down the side road. I now want to
rent the farm land that I still own and the farmer again wants to
put cattle on the land. How can I assure him that his cattle will
be safe? Will the increased noise disturb the cattle like it does
me?The cattle cannot close the window to keep the noise out.Who
will pay for damages if the cattle hurt people attending a race
because the someone cut the fence allowing the cattle to escape?
6) POTENTIAL DANGER
I am concerned about having music festivals at Mosport because of
living so close by.I not only hear music for the entire weekend I
also hear the chanting of the crowds. This is a very serious when
I find the police net that they have setup to control people is
including my home!! The police leave before all the people leave
and I'm forced to keep watchful eye on all the strangers travelling
up and down our side road. If the weather is bad on that weekend I
got people coming in to ask me for the use of my phone on a regular
basis.
7)I have a family that has lived in the country all of our lives
and I hate having my weekend disturbed all summer long when me and
my wife work all week and look forward to the weekend for
quiet,rest and relaxation in this rushed society we live in.
I have lived on this property all my life and have enjoyed the
countryside I live in. The building of this now track and the
continual enhancements the this track is bringing -to this area is
threatening the privacy of my home and the pleasures of playing
with my own children on the weekend. I do not what to become
captive in my own home. I do not want overnight camping concerts
or live
entertainment
