Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -15 -94 be received;
2. THAT application to amend the Comprehensive Zoning By -law 84-
63 of the former Town of Newcastle, as amended, submitted by
D.G. Biddle and Associates on behalf of W.E. Roth Construction
Limited be referred back to Staff for further processing and
the preparation of a subsequent report upon receipt of all
outstanding comments; and
3. THAT the Durham Region Planning Department, and all interested
parties listed in this report and any delegation be advised of
Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: D.G. Biddle and Associates
1.2 'Owner: W.E. Roth Construction Limited
1.3 Rezoning: From "Urban Residential Type One (R1)" to a
zone appropriate to permit the development of
a parking area.
1.4 Area: 908 square metres
2. LOCATION
2.1 The lands subject to the rezoning application to permit a
parking area are located in Part of Lot 10 Concession 1,
former Town of Bowmanville. The municipal address of the site
is 15 Church Street. ....2

3 BACKGROUND
3.1 In 1989, a Rezoning and Official Plan Amendment Application
was submitted on these lands to permit a parking area at 15
Church Street to be used in conjunction with the lands zoned
commercially at 196 King Street East. On February 4, 1991,
Council recommended that the official plan amendment
application (89- 069/N) to permit the parking area be approved
and that a zoning by -law be passed when the official plan
amendment receives Ministerial approval and a site plan
agreement is entered into with the Municipality. The Minister
approved Amendment #42 on April 3, 1992. On December 22, 1993
Staff were advised that the subject lands had been purchased
by W.E. Roth Construction and new plans were submitted for the
parking area. Although Council has previously approved the
rezoning for a parking area, Staff requested a new rezoning
application be filed to reflect the recent change in ownership
and new site plan.
4 EXISTING AND SURROUNDING USES
4.1 Existing Uses:
a detached dwelling unit and shed to be demolished
4.2 Surrounding Uses:
East - existing residential and commercial
West - existing residential
South - detached dwelling unit (to be demolished)
North - existing residential and Vincent Massey Public
School
5 OFFICIAL PLAN POLICIES
5.1 With Amendment #42 being granted Ministerial Approval, the
subject lands have been designated "Low Density Residential
permitting a parking area" within the "Main Central Area ".
The proposal conforms.

6 ZONING BY -LAW PROVISIONS
6.1 The subject lands are presently zoned "Urban Residential Type
One (R1). A rezoning is required to permit a parking area.
7 PUBLIC MEETING AND SUBMISSION
7.1 Pursuant to Council's Resolution of July 26, 1982 and the
requirements of the Planning Act the appropriate signage
acknowledging the application was installed on the subject
lands. In addition, the appropriate notice was mailed to each
landowner within the prescribed distance.
8 AGENCY COMMENTS
8.1 In accordance with departmental procedures, the application
was circulated to obtain comments from other departments and
agencies. The following departments/ agencies in providing
comments, offered no objection,to the application as filed:
Municipality of Clarington Fire Department
Durham Region Planning Department
8.2 The Clarington Hydro Electric Commission advised that Hydro
will be provided at the developer's cost via an underground
cable system with a pad- mounted transformer. It was further
noted that any relocation or modification of the existing
power distribution plant will be the developer's expense.
8.3 Comments have yet to be received from the following agencies:

Municipality of Clarington Community Services
Department
Durham Region Works Department
Central Lake Ontario Conservation Authority
Ministry of Natural Resources
Northumberland and Newcastle Public School Board

9 STAFF COMMENTS
9.1 The purpose of this report is to facilitate the Public Meeting
as required by the Planning Act, to provide Committee and
Council with some background on the application submitted and
for Staff to indicate issues or areas of concern regarding the
subject application. It is recommended the application be
referred back to Staff for further processing and subsequent
report upon receipt of all outstanding comments and required
revisions.
