Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD -10 -94 be received;
2. THAT application to amend the Comprehensive Zoning By -law 84-
63 of the Former Town of Newcastle, as amended, submitted by
Chris Lapa on behalf of J.B. Scott be referred back to Staff
for further processing and the preparation of a subsequent
report upon receipt of all outstanding comments; and
3. THAT the Durham Region Planning Department, and all interested
parties listed in this report and any delegation be advised of
Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Chris Lapa
1.2 Owner: J. B. Scott
1.3 Rezoning: From "Agricultural (A)" to a zone appropriate to
permit a private club comprised of a club house and
two unspecified sports playing fields
1.4 Area: 4.08 hectares
2. LOCATION
2.1 The subject lands are located in Part of Lot 15 Concession 6,
former Township of Clarington. The lands are located on the north
side of Concession Road 6 just west of Cedar Park Road.

3 BACKGROUND
3.1 On November 30, 1993 an application for rezoning and site plan
approval was received by the Planning Department. This application
proposes the erection of a 1500 square metre club house and the
creation of two playing fields suitable for football, soccer,
baseball, etc.

5 OFFICIAL PLAN POLICIES
5.1 According to the Durham Region Official Plan 1991, the lands are
designated General Agricultural Area. The Future 407 Freeway with
a Major Open Space buffer appears to be located on the west
boundary of the site. Lands designated General Agricultural Area
shall be used predominantly for agriculture and farm - related uses.
Other uses such as riding and boarding stables, kennels, allotment
gardens, fur and sod farms are also permitted. Uses such as
private clubs and recreational facilities are not permitted.
6 ZONING BY -LAW PROVISIONS
6.1 According to the Comprehensive Zoning By -law 84 -63, as amended of
the former Town of Newcastle, the subject site is zoned
"Agricultural (A) ". Lands so zoned shall be for agricultural and
farm related uses. As such, the use proposed requires an amendment
to the Zoning By -law.
7 PUBLIC MEETING AND SUBMISSION
7.1 Pursuant to Council's Resolution of July 26, 1982 and the
requirements of the Planning Act the appropriate signage

acknowledging the application was installed on the subject lands.
In addition, the appropriate notice was mailed to each landowner
within the prescribed distance.
7.2 A few residents have requested further information on the proposed
application and a copy of this report has been sent to these
residents. Upon speaking to these people, they were non - committal
regarding whether they supported or opposed the application.
8 AGENCY COMMENTS
8.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies.
The following departments /agencies were circulated:
Municipality of Clarington Public Works Department
Municipality of Clarington Community Services Department
Municipality of Clarington Fire Department
Durham Region Planning Department
Durham Region Health Department
Central Lake Ontario Conservation Authority
Ministry of Natural Resources
Ministry of Transportation
Ministry of Agriculture and Food
8.2 Comments have been received from the Clarington Public Works
Department and they offer no objection subject to the following:
• that the applicant /owner is responsible for any costs
necessary to facilitate the construction of an access onto
Concession Road 6 including providing for illumination of the
access onto Concession Road 6
• that the applicant /owner make application for property access
• that any easement or 0.3 metre reserves required are granted
free and clear of any encumbrances to the Municipality, and
• that the applicant /owner meet all requirements of the Public
Works Department financial or otherwise

8.3 The Clarington Fire Department has no objection to the application,
but notes that the site is not serviced by municipal water and
that water for fire fighting purposes must be supplied by fire
department tankers.
8.4 The Durham Region Health Department could not provide detailed
comments until the following information is provided:
• the number of seating available in the club house
• the number and type of water fixtures
• a site plan showing sewage disposal area and replacement area
• the type of water supply proposed
The applicant has been advised that the Health Department is
awaiting the above information and that the Municipality will not
be able to proceed to process this application until such time as
the Regional Health Department is satisfied.
8.5 The Durham Region Planning Department has stated that the proposed
use is not permitted and as such, this application does not comply
with the 1991 Durham Region Official Plan.
9 STAFF COMMENTS
9.1 Staff have discussed with the applicant the ramifications of the
agency comments received to date. The applicant wishes to await
receipt of all agency comments prior to making a decision with
respect to whether an application to amend the Durham Region
Official Plan will be made.
10 CONCLUSION
10.1 The purpose of this report is to facilitate the Public Meeting as
required by the Planning Act, to provide Committee and Council with
some background on the application submitted and for Staff to
indicate issues or areas of concern regarding the subject
application. It is recommended the application be referred back to
Staff for futther processing and subsequent report upon resolution
of the above issues and receipt of all outstanding comments and
required revisions. ....5
