RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-050-04 be received;
2. THAT the application submitted by 289143 Ontario Limited to remove the Holding (H)
symbol be APPROVED and that the attached by-law to remove the Holding (H) symbol
be passed and a copy forwarded to the Regional Municipality of Durham;
3. THAT the request for removal of Part Lot Control with respect to Lots 58-63 inclusive
and Lots 73-81 inclusive, on Plan 40M-2178 be APPROVED and that the attached Pari
Lot Control By-law be passed pursuant to Section 50 (7.1) of the Planning Act; and
4. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

1.4 Part Lot Control Removal:
Lots 58-63 inclusive and 73-81 inclusive, Plan 40M-2178 (Attachment 2).
2.0 BACKGROUND
2.1 On March 1, 2004, Staff received a request from 289143 Ontario Limited for the
removal of the "Holding (H)" symbol from the recently registered Plan of Subdivision
40M-2178.
2.2 On April 14, 2004, Staff received a request from 289143 Ontario Limited for the removal
of Part Lot Control with respect to Lots 58-63 inclusive, and Lots 73-81 on Plan 40M-
2178.
2.3 Draft Plan of Subdivision 18T -95023 received approval for one hundred and fourteen
(114) semi-detached dwelling units. Registration of Plan of Subdivision 40M-2178,
which is the first phase of the Draft plan, included approval for thirty (30) semi-detached
dwellings in November, 2003. The removal of Part Lot Control would facilitate the
construction of the approved semi-detached dwelling units.
3.0 COMMENTS
3.1 The "Holding (H)" symbol affects Lots 1-152 inclusive, Block 163, and Blocks 170-174
inclusive on Plan 40M-2178. The applicant has entered into a subdivision agreement
with the Municipality and there are sufficient financial guarantees to ensure completion
of subdivision 40M-2178.
3.2 Staff has no objection to the approval of a By-law exempting the subject lands from Part
Lot Control. Attached is a By-law (Attachment 4) to exempt the subject lands from
Section 50 (5) of the Planning Act.

3.3 Attachment 5 is a Summary Table provided in accordance with the Region of Durham's
requirements under the delegation of Part Lot Control. It details lots affected by the Part
Lot Control By-law, the unit type and the number of the Part Lot Control By-law.
3.4 The Finance Department has confirmed that the taxes are up to date for the subject
properties.
4.0 RECOMMENDATIONS
4.1 In consideration of the comments noted above, approval of the removal of the "Holding
(H)" symbol as shown on the attached by-law and schedule (Attachment 3) is
recommended.
4.2 In accordance with Subsection 7.3 of Section 50 of the Planning Act, the Part Lot
Control By-law may provide a specified timeframe during which the By-law shall be in
force. As a result, it is not necessary for Staff to prepare a second By-law to restore
Part Lot Control on the subject lands. The Planning Act leaves it to the Municipality to
determine an appropriate timeframe during which the By-law shall apply. Staff
recommends that the By-law be in force for a three (3) year period following Council
approval, ending May 10, 2007.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2004-
being a by-law to amend By-law 84-63, the Comprehensive Zoning By-law for the
Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable
to amend By-law 84-63, as amended, of the Corporation of the former Town of Newcastle to
implement ZBA 2004-012;
NOW THEREFORE BE IT RESOVED THAT the Council of the Corporation of the Municipality
of Clarington enacts as follow:
1. Schedule "1" to By-law 84-63, as amended, is hereby further amended by changing the
zone designation from:
Holding - Urban Residential Exception ((H)R1-41) Zone
Holding - Urban Residential Exception ((H)R1-42) Zone
Holding - Urban Residential Exception ((H)R2-11) Zone
Holding - Urban Residential Exception ((H)R2-12) Zone
Holding - Urban Residential Exception ((H)R2-13) Zone
To:
Urban Residential Exception (R1-41) Zone
Urban Residential Exception (R1-42) Zone
Urban Residential Exception (R2-11) Zone
Urban Residential Exception (R2-12) Zone
Urban Residential Exception (R2-13) Zone
2. Schedule "A" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Sections 34 and 36 of the Planning Act.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2004-
being a by-law to exempt a certain portion of Registered Plan 40M-2178 from Part Lot
Control
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable
to exempt from Part Lot Control, Lots 58-63 inclusive and Lots 73-81 inclusive, on Plan 40M-
2178. registered at the Land Title Division of Whitby:
NOW THEREFORE BE IT RESOVED THAT the Council of the Corporation of the Municipality
of Clarington enacts as follow:
1. That Subsection 5 of Section 50 of the Planning Act, this By-law shall not apply to those
lands described in Paragraph 2 within the By-law.
2. That this By-law shall come into effect upon being approved by the Municipality of
Clarington and thereafter Subsection 5 of Section 50 shall cease to apply to the
following lands:
a) Lots 53-63 inclusive, and Lots 73-81 inclusive on Plan 40M-2178;
3. Pursuant to Subsection 7.3 of Section 50 of the Planning Act, this By-law shall be in
force for a period of three (3) years ending on May 10, 2007
