THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2004-191
being a by-law to approve Minutes of Settlement of appeals by
Hendry Investments Limited to the Ontario Municipal Board
from Official Plan Amendment No. 36 and Zoning By-law 2003-
153
WHEREAS Hendry Investments Limited is the beneficial owner of 252 King
Street East and 9 St. George Street South, Bowmanville, and has appealed to
the Ontario Municipal Board from the approval of Official Plan Amendment No.
36 and the passing of Zoning By-law 2003-153;
AND WHEREAS the Solicitor and Mr. Carlo Pellarin of the Planning Services
Department have negotiated a settlement of these appeals with Hendry
Investments Limited;
AND WHEREAS Minutes of Settlement dated July 20, 2004 have been executed
by Dennis Hefferon on behalf of the Municipality and B.P. Stelmach on behalf of
Hendry Investments Limited;
AND WHEREAS paragraph 5.1 of the Minutes of Settlement provides that they
will be binding on the parties if they are approved on or before September 13,
2004; otherwise they will be null and void;
AND WHEREAS the Solicitor recommends that Council approve the Minutes of
Settlement and staff support this recommendation,
THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
CLARINGTON hereby enacts as follows:
1. Minutes of Settlement of the appeals to the Ontario Municipal Board by
Hendry Investments Limited from the approval of Official Plan Amendment
No. 36 and the passing of Zoning By-law 2003-153 are approved by The
Corporation of the Municipality of Clarington.
2. The Solicitor is authorized to request that the Ontario Municipal Board
implement the provisions the aforesaid Minutes of Settlement that deal
with the Official Plan Amendment No. 36 and Zoning By-law 2003-153.
By-law read a first and second time this ih day of September, 2004.
By-law read a third time and finally passed this 7th day of September, 2004.
