THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2004-190
being a by-law to authorize an appeal of the decision of Madam
Justice Boyko of the Ontario Superior Court in Newcastle
Recycling Ltd. and Others v. Municipality of Clarington to the
Ontario Court of Appeal
WHEREAS Council has received the report of the Solicitor respecting the
decision of Madam Justice Boyko of the Ontario Superior Court of Justice in
Newcastle Recycling Ltd. and Others v. Municipality of Clarington which was
issued on August 11, 2004.
THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
CLARINGTON hereby enacts as follows:
1. The Municipality of Clarington hereby determines to appeal the decision of
Madam Justice Boyko in Newcastle Recycling Ltd. and others v.
Municipality of Clarington to the Ontario Court of Appeal.
2. The Solicitor is authorized to take all steps that he considers to be
necessary to prosecute the appeal successfully.
By-law read a first and second time this yth day of September, 2004.
By-law read a third time and finally passed this yth day of September, 2004.
