CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2004- 145
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for
the Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the former Town
of Newcastle to implement proposed draft Plan of Subdivision 18T - 93008
NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Section 13.4 "SPECIAL EXCEPTIONS - URBAN RESIDENTIAL TYPE TWO
(R2) ZONE" is hereby amended by adding thereto the following new Special
Exceptions 13.4.33, 13.4.34 and 13.4.35 as follows:
"SECTION 13.4.33 URBAN RESIDENTIAL EXCEPTION (R2-33) ZONE"
Notwithstanding Section 13.2 those lands zoned R2-33 on those Schedules to
this By-law shall be subject to the following zone provisions:
a)
Yard Requirements (minimum)
i) Exterior Side Yard
ii) Sight Triangle
3.0 metres
5.0 metres
"SECTION 13.4.34 "URBAN RESIDENTIAL EXCEPTION (R2-34) ZONE":
Notwithstanding Section 13.2 those lands zoned R2-34 on the Schedules to this
By-law shall be subject to the following zone regulations:
a)

Lot Area (minimum)
Yard Requirements (minimum)

ii) Sight Triangle
340 sq. m.

"SECTION 13.4.35 "URBAN RESIDENTIAL EXCEPTION (R2-35) ZONE":
Notwithstanding Section 13.2 those lands zoned R2-35 on the Schedules to this
By-law shall be subject to the following zone provisions:
a)
Lot Area (minimum)
360 sq. m.
2. Schedule 3 to By-law 84-63 as amended is hereby further amended by changing
the zone designation from:
"Holding-Urban Residential Type One ((H) R1) Zone" to "Environmental
Protection (EP) Zone";
"Holding-Urban Residential Type One ((H) R1) Zone" to "General Industrial
Exception (M2-1) Zone";
"Holding -Urban Residential Type One ((H)R1) Zone" to "Holding-Urban
Residential Type Two ((H) R2) Zone";
"Holding -Urban Residential Exception ((H) R2-6 Zone" to "Urban Residential
Exception (R2-33) Zone";

"Holding - Urban Residential Exception ((H)R2-7) Zone" to "Urban Residential

Exception (R2-35) Zone".
5. Schedule "A" attached hereto shall form part of this By-law.
6. This By-law shall come into effect on the date of the passing hereof, subject to
the provisions of Section 34 and 36 of the Planning Act.
