CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 2004-062
being a by-law to authorize an application to be made to Council as the
approving authority under the Expropriations Act, R.S.O. 1990, c.E.26 for the
approval of the expropriation of all interests in the lands described as the portion
of Part Lot 31, Concession 1, former Township of Clarke, shown as Part 1 on the
draft plan of survey attached to this By-law, for the purposes of a community park
WHEREAS at its meeting on March 1, 2004, Council approved Report PSD-025-04
which recommended enactment of this By-law:
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF CLARINGTON ENACTS AS FOLLOWS:
1. That Council hereby authorizes an application to be made to the Council of the
Corporation of the Municipality of Clarington as the approving authority under
subsection 4(1) of the Expropriations Act R.S.O. 1990 c.E.26, as amended, for
the approval of the expropriation of all interests in the lands described as the
portion of Part Lot 31, Concession 1, former Township of Clarke shown as Part 1
on the draft plan of survey attached to this By-law, for the purposes of a
community park.
2. That Council hereby authorize staff to take all necessary actions to serve notice
of its application for approval to expropriate upon the owners of the land to be
expropriated and to publish the aforesaid notice in accordance with subsection
6( 1) of the Expropriations Act.
