THAT Report PD -2 -94 be received; 2. THAT application to amend the Comprehensive Zoning By -law 84- 63, as amended, of the former Town of Newcastle submitted by D. G. Biddle and Associates on behalf of 290572 Ontario Limited requesting the removal of the "Holding (H) symbol from the subject lands within draft plan of subdivision 18T- 87092, being within part of Lot 29, Concession 2, former Township of Darlington for part of Phase I be Approved and the By -law attached hereto be forwarded to Council for approval; 3. THAT the interested parties listed in this report and any delegation be advised of Council's decision, and 4. THAT a copy of this report and the amending by -law be forwarded to the Region of Durham Planning Department. 1 APPLICATION DETAILS 1.1 Applicant: 290572 Ontario Limited 1.2 Agent: D. G. Biddle & Associates Limited 1.3 Rezoning: Removal of "Holding (H)" provision 1.4 Proposed Plan of subdivision: to permit the development of one (1) single family dwelling lot, part of two (2) semi- detached /link lots (4 units) and part of one (1) single family dwelling lot (see attached). ....2 2 N E� L HIS ( 4 PE Y.-PAPER REPORT NO. PD -2 -94 PAGE 2 2® BACKGROUND: 2.1 Council in October of 1992, recommended approval of proposed plan of subdivision (18T- 87092) and associated zoning by -law amendment (DEV 88 -116) . At that time the lands subject to this application for removal of holding were not part of the draft plan or the rezoning application. Prior to draft approval being received the applicant amended the application for proposed plan of subdivision to include the additional land. 2.2 On June 28, 1993, Council approved By -law 93 -100 removing the (H) Holding symbol from the lands associated with DEV 88 -116. This again did not include the subject lands. 2.3 This application to remove the Holding (H) symbol from the subject property was received Nov 18, 1993. The subject land is located in Part Lot 29, Concession 2, former Township of Darlington and is municipally known as 2558 and 2546 Courtice Road and is now part of registered plan of subdivision 40M- 1746. 3 STAFF COMMENTS 3.1 The subject lands are currently zoned "Holding - Urban Residential Type One ((H)R1)", which would permit both the single family dwelling unit and semi - detached /link units proposed. The "Holding (H)" symbol can be removed, by by- law, upon Council being satisfied that the uses to be permitted will be adequately serviced, have appropriate access, and will be used for the purpose intended by the By- law. 3.2 The applicant has entered into a development agreement with the municipality, as well as a servicing agreement with the ....3 r, 1'K J ► J REPORT NO. Staff are therefore satisfied that all the provisions for the removal of Holding (H) symbol have been satisfied. 3.3 Staff would note for Committee's information that pursuant to Section 36 of the Planning Act, a By -law Amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a standard rezoning application, and accordingly shall be deemed final and binding should Council grant approval of same. 4 RECOMMENDATION: 4.1 In consideration of the comments contained within said report, Staff would have no objection to the removal of the "Holding (H)" symbol as indicated on the attached by -law. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of -the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule 114" to By -law 84 -63 as amended, is hereby further amended by changing the zone catagory from "Holding Urban Residential Type One ( (H) R1) " to "Urban Residential Type One (R1) as illustrated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing hereof, subject to the provisions of Section 36 of the Planning Act.
