Foxhunt Trail to Darlington Boulevard
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report COD-022-05 be received;
2. THAT 614128 Ontario Ltd. o/a Trisan Construction, Schomberg, Ontario with a total bid
in the amount of $74,895.05 (Plus G.S.T.), being the lowest responsible bidder meeting
all terms, conditions, and specifications of Tender CL2005-1, be awarded the contract
for the Pedestrian Walkway, Courtice - Foxhunt Trail to Darlington Boulevard as required
by the Engineering Department;
3. THAT the total funds required in the amount of $101,000.00 ($74,895.05 tender plus
contingencies, consulting, soils and utilities) be drawn from Engineering Capital Account
#110-32-331-83213-7401, ($80,000.00) as carried over from 2003 and an additional
$21,000.00 from the Roads Contribution Reserve Fund;
4. THAT the attached By-law marked Schedule "A" authorizing the Mayor and the Clerk to
execute the necessary agreement be approved.

BACKGROUND AND COMMENT
Council at the meeting of February 28, 2005, authorized staff to proceed with the advertising
and issue of this tender in advance of the 2005 Capital Budget Approval. Tender specifications
were provided by Totten Sims Hubicki Associates for the Pedestrian Walkway, Courtice _
Foxhunt Trail to Darlington Boulevard, as required by the Engineering Department.
Tenders were advertised in local papers, as well as electronically. Subsequently, tenders were
received and tabulated as per Schedule "B" attached.
The total project cost, including Project Administration, and costing allocation is as detailed in
the letter from Totten Sims Hubicki Associates, marked Schedule "C" and will be provided from
Account #110-32-331-83213-7401 as carried over from 2003 with the additional funds being
drawn from the Roads Contribution Reserve Fund.
The low bidder has previously performed satisfactory work for the Municipality of Clarington.
The Director of Finance has reviewed the funding requirements and concurs with the
recommendation. Queries with respect to department needs, specifications, etc., should be
referred to the Director of Engineering.
After further review and analysis of the bids by the Engineering Department, Totten Sims
Hubicki Associates and Purchasing, it was mutually agreed that the low bidder, 614128 Ontario
Ltd., o/a Trisan Construction, Schomberg, Ontario, be recommended for the contract for the
Pedestrian Walkway, Courtice - Foxhunt Trail to Darlington Boulevard.

BY-LAW 2005-
Being a By-law to authorize a contract between the
Corporation of the Municipality of Clarington and 614128
Ontario Ltd., o/a Trisan Construction, Schomberg, Ontario, to
enter into agreement for the Pedestrian Walkway, Courtice -
Foxhunt Trail to Darlington Boulevard.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the
Corporation of the Municipality of Clarington and seal with the Corporation Seal, a
contract between, 614128 Ontario Ltd., o/a Trisan Construction, Schomberg,
Ontario, and said Corporation; and
2. THAT the contract attached hereto as Schedule "A" form part of this By-law.

· Bid Amendment - Error in extension
The low bidder's tender has been checked and is in order. Trisan Construction has completed a number
of projects for the Municipality of Clarington, most recently Contract No. CL2004-30, the 2004 sidewalk
replacement and the CL2003-16, 2003 sidewalk replacement. The Contractor performed the concrete
construction to an acceptable standard with the only issue arising during the contracts being the delay in
completing the restoration work. These recent contracts ranged in value from $175,000.00 to
$183,000.00. The Contractor will be using Otonabee Utility Service Inc. to complete the electrical
portion of the lighting. Otonabee Utility has worked as a sub-contractor on a number of Region of
Durham and Municipality of Clarington projects and has completed the required electrical works to an
acceptable level. Based on past performance, we recommend that Trisan Construction be awarded
Contract CL2005-1.

Funding for this project is to be provided from Engineering Services' Account Number 110-32-331-
83213-7401 which has $80,000,00 (exc. GST) allocated in the 2003 Budget and carried over to 2005.
Based on total project costs and available budget, there is a deficit of approximately $21,000.00,
The reasons for the deficit are the unexpected design costs for the retaining wall, redesign that occurred as
a result of changes made to the alignment by the Planning Department, a higher than expected tender
amount and the additional time spent preparing material for the Planning Department, as requested, for
land purchase negotiations with the owners of the Waltzing WeaseL
Additional funding for this project shall be provided from the Road Contribution Fund,
