HomeMy WebLinkAboutPD-59-89DN: 15. �b .. 5 (h) TOWN OF NEWCASTLE REPORT File #4'e Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, March 6, 1989 REPORT #: PD -59 -89 FILE #: 18T -78027 SLRECT: PROPOSED PLAN OF SUBDIVISION - 772503 ONTARIO LIMITED (CHALLENGER PARK SUBDIVISION) PART LOT 26, CONCESSION 2, FORMER VILLAGE OF NEWCASTLE 1) SUBDIVISION AGREEMENT - AUTHORIZING BY -LAW 2) STREET NAMES - 18T -78027 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: .l. THAT Report PD -59 -89 be received; and 2. THAT the request for relief from current Town Policy with respect to three (3) street names in Plan of Subdivision 18T- 78027, 772503 Ontario Limited, be approved; and 3. THAT the attached by -law authorizing execution of a Subdivision Agreement between 772503 Ontario Limited and the Corporation of the Town of Newcastle, be approved; and 4. THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between 772503 Ontario Limited and the Corporation of the Town of Newcastle, at such time as an Agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. ...2 538 REPORT NO.: PD -59 -89 PAGE 2 --------------------°--------------------------a-------------_-------------------- 1. BACKGROUND 1.1 On September 14, 1987, the Town of Newcastle Council resolved to approve street names in new Plans of Subdivision after people historically significant to the former Township of Clarke and Darlington. In that regard, if street names were chosen which were not in accordance with Town Policy, they must be considered by Council prior to registration. 2. STAFF COMMENTS 2.1 In consideration of the Owner's involvement in the Canadian - United States Air Shuttle Program, street names McNair and McAuliffe, have been requested in honour of the names of two (2) of the individuals who perished in the Challenger Program. Additionally, the name "Challenger" has been requested in consideration of the Owner's wishes to the naming of the subdivision - "Challenger Park ". Staff would note the remaining street names in the Plan of Subdivision comply with Town Policy. 3. SUBDIVISION AGREEMENT 3.1 Staff would note for the Committee's information that the above -noted Plan of Subdivision, as previously considered by Committee and Council, has received draft approval. Among the conditions of approval was the requirement that the Owner agree, in writing, to satisfy all the requirements, financially and otherwise. 3.2 The Owner of the subject lands, through the Consulting Engineer, G.M. Sernas and Associates, have submitted a draft agreement from Staff's review. 3.3 The Draft Agreement has been subsequently returned to reflect the Town's Development Agreement, as amended. 5 .� 9 REPORT ND.: PD-59-89 ______________________ 4. CONCLUSION PAGE 3 _____________ 4.1 In order to facilitate execution of the Agreement, an Authorizing By-law as attached hereto, is submitted for Committee's information and consideration. 4.2 In consideration of the 0woez`a request and "theme-name" proposed for the Plan of Subdivision, Staff would have no objection to the proposed street names. WHEREAS the Council of the Corporation of the Town of Newcastle deems it appropriate to enter into an Agreement in respect of Subdivision 18T- 78027; The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, an Agreement between 772503 Ontario Limited and the said Corporation dated the day of , 1989, in the form attached hereto as Schedule nXn 2. THAT the Mayor and Clerk are hereby authorized to accept, on behalf of the Town, the said conveyances of lands required pursuant to the aforesaid Agreement. 3. THAT Schedule "X" attached hereto forms part of this By -law.
