OFFICIAL PLAN PERTAINING TO PARKLAND POLICIES

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD -66 -89 be received; and
2. THAT the Region of Durham and the Ministry of Housing be advised:
(i) that the Town has no objection to the proposed modifications
to the Parkland Policies as contained in the letter dated February
1, 1989 from Ms. Francoise Caron;
(ii) That Section 6.3.2(ii)(a) be further modified by inserting the
word "generally" before the word "comprises" as it appears in the
second line and by replacing the word "may" with "shall" as it
appears in the sixth line so that the entire section now reads:
"The Major Open Space System within the Courtice Major Urban
Area generally comprises those lands below the topographic
break in slope of the Black and Farewell Creek systems. The
boundaries of the Major Open Space System shown on Schedule 6-
1 are not precise and shall only be used as guidelines. More
precise boundaries shall be delineated in the Zoning By -law in
consultation with Central Lake Ontario Conservation Authority
and the Ministry of Natural Resources. Council shall
encourage the public acquisition of and access to, for passive
recreational purposes, the valley lands of the Black and
Farewell Creek systems. "; and
3. THAT the Region of Durham and the Ministry of Housing be forwarded a
copy of this Report.

1. BACKGROUND:

1987, the Minister of Municipal Affairs approved the
the Official Plan for the former Township of

1.2 As Council is aware, the policies and land use schedules for the Hamlet
Secondary Plans were recently approved by the Region of Durham on
January 11, 1989. These are now before the Minister for approval.
1.3 On February 1, 1989, Ms. Francoise Caron of the Ministry of Municipal
Affairs wrote to the Town with proposed modifications to the Parkland
Policies as adopted by Town Council on June 8, 1987. (Attachment # 1)
In addition, the comments of the Central Lake Ontario Conservation
Authority and the Ministry of Natural Resources were also forwarded to
the Town for consideration. The Ministry suggests that additional
modifications may be warranted following the review by the Town and the
Region.
2. COMMENTS:
2.1 The modifications proposed by the Ministry of Municipal Affairs are
technical in nature. They are principally gramatic and numbering
corrections. A reference to the Neighbourhood Development Plan is
deleted and replaced by a reference to the Zoning By -law.
Staff find the proposed modifications appropriate and acceptable.

2.2 The Central Lake Ontario Conservation Authority has no difficulty with
the proposed parkland policies with one exception. C.L.O.C.A. has
proposed a revision to Section 6.3.2(ii)(a) for the Courtice Urban
Area. At the present time, the policy states that the Major Open Space
System in Courtice "comprises those lands below the topographic break
in slope of the Black and Farewell Creek systems ". C.L.O.C.A. notes
that to the north and east of the Courtice Urban Area are extensive
areas of significant forest, wildlife habitat, organic soils and high
water table. Given the high environmental sensitivity for these areas,
they suggest that the policy should not limit the Major Open Space
System to the topographic break in slope of the valleylands.
It should be noted that the Durham Region Official Plan does not
restrict the "Major Open Space" designation to the valleylands. In as
much as the Town of Newcastle Official Plan must implement the Durham
Region Official Plan, the Major Open Space designation in the Town's
Official Plan will conform to this designation.
Staff have no objection to a modification which would recognize that
the Major Open Space designation is not necessarily limited to the
valleyland areas. It is recommended that the wording be changed from
"...comprises those lands..." to "generally comprises those lands" in
the sentence noted above. This would also make the Courtice policy
section consistent with the Bowmanville and Newcastle Village policy
section.
2.3 The Ministry of Natural Resources supports the proposed parkland
policies but suggests two modifications. It is suggested that the
Section 6.3.2(ii)(a) should be amended to indicate that more precise
boundaries to the Major Open Space system "shall be delineated" in
the Zoning By -law. Currently, the policy section reads "may be
delineated ".
Staff agree with this modification. It would make the Courtice policy
section consistent with the Bowmanville and Newcastle Village policy
sections.

The second suggestion is that the Bowmanville Urban Area policies state
that in addition to encouraging public acquisition of the valleyland
areas, the Lake Ontario Waterfront be included for potential public
acquisition. Staff have no objection to this in principle, but note
that the Bowmanville Urban Area does not extend to the waterfront. This
area is part of the rural area and, as such, such a modification is not
appropriate.
3. SUMMARY:
3.1 The modification proposed by the Ministry of Municipal Affairs are
technical and, as such, staff have no objections. In addition, in
response to the suggestions of Central Lake Ontario Conservation
Authority and Ministry of Natural Resources it is recommended that
Section 6.3.2(ii)(a) be modified as indicated by the bold lettering as
follows:
"The Major Open Space System within the Courtice Major Urban Area
generally comprises those lands below the topographic break in
slope of the Black and Farewell Creek systems. The boundaries of
the Major Open Space System shown on Schedule 6 -1 are not precise
and shall only be used as guidelines. More precise boundaries
shall be delineated in the Zoning By -law in consultation with
Central Lake Ontario Conservation Authority and the Ministry of
Natural Resources. Council shall encourage the public acquisition
of and access to, for passive recreational purposes, the valley
lands of the Black and Farewell Creek systems."

Our circulation of the proposed revisions to the
Parkland Policies of the Former Township of
Darlington Official Plan (as amended by Amendment
No. 22), is now complete.
Enclosed please find a copy of the comments
received from the Ministry of Natural Resources and
the Central Lake Ontario Conservation Authority.
We would appreciate receiving your comments on the
modifications requested by both agencies.
In addition, I have enclosed the proposed revisions
to the Parkland Policies, for your review. Some
slight modifications have been incorporated into
the original proposed revisions submitted by the
Region in July, 1987, and are indicated in bold
lettering.
The agencies' comments have not been taken into
account in the formulation of the attached proposed
revisions. As such, additional modifications may
be warranted, following the Region's and the Town's
review of the agencies' comments.

OF THE FORMER TOVNSHIP OF DARLINGTON OFFICIAL PLAN
a) Section 6.3.2 (ii) a) is modified to read as
follows:
"The Major Open Space System within the

Black and Farewell Creek systems. The
boundaries of the Major Open Space System shown
on Schedule 6 -1 are not precise and shall only
be used as guidelines. More precise boundaries

Natural Resources. Council shall encourage the

follows:
"Neighbourhood Parks shall not normally be less
than 3 hectares in size and shall be provided
on the basis of 0.8 hectares per 1000 persons
population."
c) Section 6.3.2 (iii) c) is modified to read as
follows:
"Neighbourhood Parks smaller than the minimum
size may be permitted by Council without
amendment to this Plan after consideration of
the size of the park relative to others in the
neighbourhood, the amount of parkland already
committed for park purposes, the physical
nature of the lands in question, and its
relationship to other Open Space opportunities
such as valley lands and school sites."
d) Section 6.3.2 (iv) b) is modified to read as
follows:
"Community Parks shall not be less than 8
hectares in size and shall be provided on the
basis of 0.6 hectares per 1000 persons
population."

e) Section 6.3.2 is further modified by adding the
following new Subsection v):
"v) Parkettes
Parkettes may be provided without an
amendment to this Plan where there appear
to be physical barriers such as arterial or
collector roads and /or watercourses which
may prevent pedestrian access for young
children to a Neighbourhood or Community
Park."
f) The existing Section 6.3.2 v) is renumbered
6.3.2 vi).
g) Section 7.2.3.2 (ii) a) is modified to read as
follows:
"Major Open Space within the Bowmanville Major
Urban Area generally comprises those lands
below the topographic break in slope of the
valley lands associated with the Bowmanville
and Soper Creek systems. The boundaries of the
Major Open Space areas shown on Schedule 7 -1
are not precise and shall only be used as
guidelines. More precise boundaries shall be
delineated in the Zoning By -law in consultation
with the Central Lake Ontario Conservation
Authority and the Ministry of Natural
Resources. Council shall encourage the public
acquisition of and access to, for passive
recreational purposes, the valley lands of the
Bowmanville and Soper Creek systems."
h) Section 7.2.3.2 (iv) b) is modified to read as
follows:
"Community Parks shall not be less than 8
hectares in size and shall be provided on the

of bank) of the valley lands associated with
the Graham and Foster Creek systems, as well as
lands directly related to Lake Ontario
Waterfront. The boundaries of the Major Open
Space areas shown on Schedule 8 -1 are not
precise and shall only be used as guidelines.
More precise boundaries shall be delineated in
the Zoning By -law in consultation with the
Ganaraska Region Conservation Authority and the
Ministry of Natural Resources. Council shall
encourage the public acquisition of and access
to, for the purposes of passive recreational
activities, the valley lands of the Graham and
Foster Creek systems and the Lake Ontario
Waterfront."
m) Section 8.2.3.2 (iv) b) is modified to read as
follows:
"Community Parks shall not be less than 8
hectares in size and shall be provided on the
basis of 0.6 hectares per 1000 persons
population."
n) Section 8.2.3.2 (v) b) is modified to read as
follows:

119.5 ii) Community Parks

the Hamlets of Burketon, Enniskillen,
Hampton, Kendal, Orono, Mitchells
Corners, Newtonville, Solina and
Tyrone.
b) Community Parks shall not be less than
4 hectares in size and shall be
provided on the basis of 0.6 hectares
per 1000 persons population served.
c) Notwithstanding b) above, Community
Parks smaller than the minimum size may
be permitted by Council without an
amendment to this Plan after
consideration of the size of the park
relative to others within the hamlet."

SUBJECT: Revisions to the Parkland Policies of the
Official Plan for the Former Township
of Darlington
The above revisions to the Parkland Policies have been
reviewed by Ministry staff. While we have nd objections
to or concerns with the Neighbourhood Parks and Community
Parks policy modifications, we wish to offer the following
comments on the 'Open Space' revisions.
With regard to sections 6.3.2(ii)(a), 7.3.2(ii)(a) and
8.2.3.2(ii)(a), this Ministry supports public acquisition
of and access to, for passive recreational purposes, the
valleylands of Black, Farewell, Soper, Bowmanville, Graham
and Foster Creek systems. The aforementioned creeks are
sensitive coldwater fisheries which support populations
of trout species and provide migration routes for trout
and lake -run salmon.
Public acquisition of and access to the creek systems will
help to protect and maintain our fisheries resource. As
well, increased access will contribute to achievement of
District Fisheries Management Plan and Land Use Guideline
Targets which emphasize the need for increased numbers of
recreational fishing opportunities.
In addition to the above, this Ministry recommends that
further modifications be made to Section 7.3.2(ii)(a) to
state that "Council shall encourage the public acquisition
of and access to ..... the valleylands of the Bowmanville
and Soper Creek systems and the Lake Ontario Waterfront.
The inclusion of acquisition of and access to Lake Ontario
will help to promote the use of this fishery resource which
is currently well below our Lake Ontario Fishery Target.
Furthermore, in section 6.3.2(ii)(a), the wording should
be revised to read "More precise boundaries shall be delin-
eated in Neighbourhood Development Plans.... This new
wording allows for consistency with the remaining 'Open
Space' sections and allows for a greater commitment to this
policy.

Our File Number: O.P.A. 85 -33.
Staff of this Authority has completed a review of these revised parkland policies
for the Town of Newcastle Official Plan.
With the exception of revised Section 6.3.2 (ii) (a), we have no difficulty with
these revised policies.
Section 6.3.2 (ii) (a), as revised, proposes that the Major Open Space System
in the Courtice Major Urban Area would be comprised of those lands below
the topographic break in slope of the Black and Farewell Creek Valleys.
Immediately to the north and east of the presently designated Courtice Urban
Area, there are extensive areas of significant forest, wildlife habitat, organic
soils and high water table.
These factors have combined to produce a high environmental sensitivity rating
for these areas, which extend a considerable distance from watercourses or
stream valleys. Besides being portrayed as environmentally sensitive in the
Durham official plan, these areas are also designated Major Open Space.

We recognize that the revised park policies, once adopted, will probably be
in effect for many years. If the Courtice Urban Area designation was to be
extended into the areas noted (which we do not recommend, it should be directed
southward towards Highway 401), and proposed section 6.32 (ii) (a) was approved,
only those sensitive areas below the topographic break in slope" would be
afforded the protection of the Major Open Space designation.
Provided proposed section 6.32 (ii) (a) was revised to protect our interests in
this regard, we would find the policies to be acceptable. A revision which would
satisfy our concerns would be worded as follows:
"The Major Open Space System within the Courtice Major
Urban Area is comprised primarily but not necessarily
limited to those lands below the topographic break in
slope of the Black and Farewell Creek system."
The remainder of proposed section 6.3.2 (ii) (a) which deals with Schedule 1,
the precise determination of major open space boundaries in development plans
and zoning by -laws, and public acquisition should be retained.
