CARRIED Councillor Woo chaired this portion of the meeting. -3- 4 -3 General Purpose and Administration Committee Minutes January 21, 2013 PUBLIC MEETING (a) Subject: Applications for a Proposed Official Plan Amendment and a Draft Plan of Subdivision Applicant: West Diamond Properties Inc. Report: PSD- 006 -13 Carlo Pellarin, Manager Development Review, made a verbal and PowerPoint presentation to the Committee regarding the application. No one spoke in opposition to or in support of the application. Kelvin Whalen, representing the applicant, was present in support of the recommendations in Report PSD- 006 -13 and was willing to answer questions of the Committee. (b) Subject: Applications for a Proposed Zoning By -law Amendment and a Draft Plan of Subdivision Applicant: 1613881 Ontario Limited Report: PSD- 007 -13 Cynthia Strike, Planner, made a verbal and PowerPoint presentation to the Committee regarding the application. No one spoke in opposition to the application. Greg Milosh, local property owner, spoke in support of the application. He asked whether the timing of the expansion of the project is contingent on the construction of the water pollution control plant. Tom Albani, Metrus Developments, was present in support of the recommendations in Report PSD- 007 -13 and was willing to answer questions of the Committee. No one spoke in opposition to or in support of the application. 4 -4 General Purpose and Administration Committee Minutes January 21, 2013 Kelvin Whalen, representing the applicant, was present in support of the recommendations in Report PSD- 008 -13 and was willing to answer questions of the Committee. Mayor Foster left the meeting at 10:08 a.m. Councillor Novak chaired this portion of the meeting. DELEGATIONS DELEGATION OF HIDA MANNS REGARDING THE DURHAM ENVIRONMENTAL ACHIEVEMENT AWARDS Hida Manns, Clarington Representative to the Durham Environmental Advisory Committee (DEAC), was present regarding the Durham Environmental Achievement Awards. She made a verbal and PowerPoint presentation to the Committee. Ms. Manns explained that her presentation today was the annual call for nominations to the Durham Environmental Achievement Awards. She explained the role of DEAC and provided details regarding the awards, including the different award categories. Resolution #GPA- 024 -13 Moved by Councillor Neal, seconded by Councillor Hooper THAT the delegation of Hida Manns, Clarington Representative to the Durham Environmental Advisory Committee (DEAC), regarding the Durham Environmental Achievement Awards, be received with thanks. CARRIED DELEGATION OF BOB OWENS REGARDING REPORT PSD- 009 -13, CLARINGTON OFFICIAL PLAN AMENDMENT NO. 89 Bob Owens, Roy Nichols Motors Ltd., was present regarding Report PSD - 009 -13, Amendment 89 to the Municipality of Clarington Official Plan to Incorporate the Courtice Mainstreet Secondary Plan Official Plan Review. He stated that he was present to request a zoning change for his properties at 2728 Highway 2 and 1752 Highway 2, in Courtice. Mr. Owens informed the Committee that his property is currently zoned Special Commercial and will remain as such as long as he is operating the car dealership business. He added that, when he ceases to operate the car dealership, which has been in place since 1922, the zoning will revert to Residential. Mr. Owens stated that he assumes the value of the properties will be much less if they revert to residential, especially without water and sewers. He noted that the Courtice Corners Plaza property, adjacent and across from Mr. Owens' properties, are zoned Commercial. Mr. Owens requested that the zoning on his properties be changed to Commercial. He explained that he had purchased more property, with the possibility of -5- 4 -5 General Purpose and Administration Committee Minutes January 21, 2013 expansion, but would like have a more options for use on these properties. Mr. Owens explained that he had not come forward earlier because, years ago, when the Official Plan was established, he was informed that there would be no change for 30 years. DELEGATION OF OLAF RUDOLPH REGARDING REPORT PSD- 009 -13, CLARINGTON OFFICIAL PLAN AMENDMENT NO. 89 Olaf Rudolph, local Courtice resident, was present regarding Report PSD- 009 -13, Amendment 89 to the Municipality of Clarington Official Plan to Incorporate the Courtice Mainstreet Secondary Plan Official Plan Review. Mr. Rudolph stated that he and his neighbours wish to have the special study area extended to the south side of Sandringham. He concluded by asking that Sandringham not be extended, but that the area be restored to a natural state. PRESENTATIONS PRESENTATION OF TED WATSON REGARDING THE 2012 CLARINGTON AGRICULTURAL ADVISORY COMMITTEE ACCOMPLISHMENTS Ted Watson, Chair, Clarington Agricultural Advisory Committee (CAAC), made a verbal presentation, accompanied by handouts, regarding the 2012 CAAC Accomplishments. He explained the changes to the executive of the CAAC and noted that the accomplishments are listed on the handout. Mr. Watson noted that he has been a member since 2002. Mr. Watson thanked Members of Council for passing supportive resolutions regarding agricultural issues. He invited Members of Council to attend the spring farm familiarization tour, to be held in conjunction with the Clarington Board of Trade. Mr. Watson urged members of Council and senior staff to attend. He made a commitment that the CAAC will continue to provide input on issues affecting agriculture. CARRIED - 11 - 4 -11 General Purpose and Administration Committee Minutes January 21, 2013 REQUEST FOR REPORT — ANIMAL SHELTER HOURS OF OPERATION Resolution #GPA- 039 -13 Moved by Councillor Neal, seconded by Councillor Partner THAT Staff investigate and report back on the opportunity to keep the Clarington Animal Shelter open until 8:00 p.m. on weekdays; and THAT the report include the protocol for providing coverage on the weekends. SOLICITOR'S DEPARTMENT ASSUMPTION OF ROAD WIDENINGS Resolution #GPA- 040 -13 Moved by Councillor Neal, seconded by Councillor Hooper THAT Report LGL- 001 -13 be received; THAT Council adopt the by -law, attached to Report LGL- 001 -13, to establish various road widenings as public highways; and THAT Council authorize the Municipal Solicitor to make an application to register the By -law. CARRIED -12- 4 -12 General Purpose and Administration Committee Minutes January 21, 2013 CHIEF ADMINISTRATIVE OFFICER SUSTAINABLE CLARINGTON COMMUNITY ADVISORY COMMITTEE TERMS OF REFERENCE Resolution #GPA- 041 -13 Moved by Councillor Novak, seconded by Councillor Hooper THAT Report CAO- 001 -13 be received; THAT Council endorse the Terms of Reference for the Sustainable Clarington Community Advisory Committee (Attachment 1 to Report CAO- 001 -13); THAT the Municipality proceed to advertise for Clarington resident's interest in public appointment to the seven (7) member Committee; THAT the members of the Living Green Community Advisory Committee be advised of Council's decision about this new Committee; and THAT Mayor Foster be appointed as the Council representative on the Sustainable Clarington Community Advisory Committee. CARRIED AS AMENDED LATER IN THE MEETING (See following motion) Resolution #GPA- 042 -12 Moved by Councillor Neal, seconded by Councillor Partner THAT the foregoing Resolution #GPA- 041 -12 be amended as follows: Add the following after paragraph two: ; and "THAT the Sustainable Clarington Community Advisory Committee structure be amended to include seven community members, the Mayor, and a Member of Council; THAT both the Mayor and Member of Council shall sit as ex- officio members with no voting rights;" -13- 4 -13 General Purpose and Administration Committee Minutes January 21, 2013 Delete the fifth paragraph, which reads as follows: "THAT Mayor Foster be appointed as the Council representative on the Sustainable Clarington Community Advisory Committee." BACKGROUND 2.1 In November 2009, Council recommended to the Ontario Municipal Board (OMB), approval of Plan of Subdivision S -C 2004 -004, and corresponding rezoning. On December 9, 2009 the OMB approved the subdivision and rezoning for 423 residential units. 2.2 A modification to the plan was made in 2011, changing the lot configuration in Phase 1. The result was a minor reduction in the number of units from 423 units to 419 units. 2.3 The draft approved plan is proceeding in two phases. Phase 1, consisting of 229 units was registered in December 2011 as 40M -2459. Phase 2 is approved for 190 units. The applicant is requesting a change in some of the lot sizes in Phase 2, reducing the number of units to 163 as illustrated in the following table. 11:4061 • 'G 2.4 Jeffery Homes and Brookfield Homes are the two builders in Phase 1 and they are committed to continue their building program in Phase 2. Home sales have generally been successful in Phase 1, particularly the single and linked product. The lane based townhouse units have generated the least interest. PROVINCIAL POLICY STATEMENT 4.1 Provincial Policy Statement. 4.1.1 The applications were reviewed in the context of the 2005 Provincial Policy Statement. New development shall occur adjacent to built up areas and shall have compact form, a mix of uses and densities that allow for the efficient use of land, infrastructure and public services. Planning authorities are required to provide for a range of housing types and densities with a ten year supply of lands which are designated and a three year supply of zoned and serviced lands within draft approved and registered plans. New housing is to be directed to locations where infrastructure and public services are or will be available. A full range of housing types and densities shall be provided to meet projected requirements of current and future residents of the regional market area. Healthy active communities should be promoted by planning public streets and spaces that are safe and facilitate pedestrian and non - motorized movement. A full range of publicly accessible built and natural setting for recreation including facilities, parks, open space and trails should also be considered. Infrastructure and public service facilities shall be provided in a coordinated efficient and cost effective manner. Planning for these shall be integrated with planning for growth so that they are available to meet current and projected needs. The use of existing infrastructure and public service facilities should be optimized where feasible before considering developing new infrastructure and public service facilities. The proposed revision to the Draft Approved Plan and proposed Zoning By -law Amendment conform with the PPS. 4.2. The Provincial Growth Plan 4.2.1 The Growth Plan provides a framework for accommodating growth in existing built up areas, through intensification and redevelopment and within greenfield areas. The subject Draft Plan of Subdivision is within a greenfield area. New development in greenfield areas are to be complete communities with access to a mix of jobs, services, housing, school recreation and open space that is easily accessed through various 8 -5 Wei . G PAGE 6 modes of transportation. The greenfield area of each upper -tier municipality will be planned to achieve a minimum density target that is not'less than 50 residents and jobs combined per hectare. Major growth is to be directed to areas serviced by existing or planned municipal infrastructure, such as water and sewer services. Natural heritage features that complement, link or enhance natural systems shall be identified and protected. The lands are within the Brookhill Neighbourhood, a community planned with a mix of housing opportunities as well as employment and recreation opportunities. The density calculated for this portion of the neighbourhood (west of Green Road) was 28.4 units per gross hectare or 74 people and jobs per hectare. The reduction in the overall units is a marginal decrease 27 units per hectare or 70 people and jobs per hectare. The subject applications are consistent with the principles of the Growth Plan. 5. OFFICIAL PLAN POLICIES 5.1 Durham Regional Official Plan 5.1.1 Inconsideration of development applications in designated Living Areas, regard shall be had for the intent of this plan to achieve the following: ■ A compact urban form; ■ The use of good urban design principles; ■ A mix of appropriate uses; ■ Linkages for pedestrians and cyclists which link communities internally and externally and to public transit; ■ A grid pattern of arterial and collector roads where necessary to support transit supportive road pattern; ■ A Greenland system that complements and enhances the Urban System; and ■ The balance between energy efficiency and cost. The application conforms to Durham Regional Official Plan policies. 5.2 Clarington Official Plan 5.2.1 In the Clarington Official Plan, the lands are designated "Urban Residential' within the Brookhill Neighbourhood. A Secondary Plan was prepared for the Brookhill Neighbourhood. The draft Plan of Subdivision is consistent with the Principles and Community Structure contained in the Secondary Plan. The neighbourhood is edged by primary road network being Brookhill Boulevard and Green Road and housing is focused around the parkette with access by rear lanes. Low Density Residential housing shall be in the form of single and semi - detached units. Coach houses are permitted in restricted areas. Low density development shall be REPORT NO.: PSD- 011 -13 developed on the basis of 30 units per net hectare, consistent with the Official Plan policies. The revised application conforms to the Official Plan policies. 6. ZONING BY -LAW 6.1 Within Comprehensive Zoning By -law 84 -63, as amended, the lands are zoned "Holding - Urban Residential Exception ((H) R1 -79) ", "Holding - Urban Residential Exception ((H) R3 -37) ", "Holding - Urban Residential Exception ((H) R3 -38) ", "Holding - Urban Residential Exception ((H) R3 -39) ". A Zoning By -law Amendment will be required in order to implement the amendment to draft plan approval. 7. PUBLIC MEETING AND SUBMISSIONS 7.1 The Public Meeting was held on December 10, 2012. One gentleman who owns property fronting onto Maple Grove Road and backing onto the subject property asked whether chain linked fencing could be installed along the property line to prevent construction garbage from accumulating,on his property. These comments will be addressed in Section 10 of this report. 8. AGENCY COMMENTS 8.1 The applications for rezoning and amendment to Draft Plan Approval are relatively minor. The circulation to outside agencies was limited to the Region of Durham only. 8.2 The Region of Durham Planning Department has indicated that the site is within the Brookhill Secondary Plan which is a designated Greenfield area. Area municipalities shall endeavour to develop its Greenfield areas in keeping with the Region's greenfields density target of 50 residents and jobs per hectare as measured over the entire Region. The revised draft plan proposes an overall decrease of 27 dwelling units. The Region does not object to the revised draft plan, however the Municipality should ensure the loss of units is compensated elsewhere in the Secondary Plan area. The Region is requesting that the Environmental Noise Report of February 2010, be updated to reflect the change in unit counts for Phase 2 development. With respect to servicing the Region advises that the applicants will be required to enter into a regional subdivision agreement for Phase 2. 9.1 The Clarington Emergency & Fire Services offers no objection provided that the rear laneways comply with all previous indicated concerns i.e.: width, parking, snow storage turning radius, hydrant locations. 9.2 The Clarington Engineering Services Department had requested additional information from the applicant's engineer regarding stormwater runoff which has been received and deemed satisfactory. The consultant has confirmed that the impervious areas will not be increased as a result of the proposed changes. Engineering Services previously expressed concern that the on -site parking may be insufficient, particularly for units around the park where on- street parking is not available immediately in front of the residential dwelling. Staff from the Engineering Services and Planning Services Department have met with the applicant and the two builders to review some parking options. This is discussed further in Section 10 of this report. 10. DISCUSSION 10.1 The amendment to the Draft Approved Plan proposes changes to some of the townhouse and semi - detached units throughout the second phase of this development. The net result is a reduction of 27 residential units. The majority of the changes take place around the parkette. The issues identified earlier have been resolved as follows: On -Site Parking The Engineering Services Department raised concerns with the lack of on -site parking for the lane -based units. The builders proposed to offer purchasers of lane -based units either a single car garage with one outdoor parking pad or a double car garage with no outdoor parking pad. What becomes problematic is that garages get filled with the home owner's personal items, potentially eliminating a space or spaces for a vehicle to park; homeowners then may park on the public road allowance. As such, the Engineering Services Department insisted that there is at least one outdoor parking space for each unit, regardless if the purchaser chooses a single or double car garage. Staff met with the applicant and the builders to review options. The builders agreed to offer options to the purchasers of lane -based products, either single car garage and one outdoor parking pad or a double car garage and one outdoor parking pad. In addition, the builders will offer to the purchaser, as an option, either a "green turf' surface for the parking pad or a paved parking pad. The "green turf' surface treatment is environmentally friendly product that allows grass to grow through a plastic structure designed to withstand the weight .1 �, �, 0 of a car. This was also deemed satisfactory by the Engineering Services Department. Lot Coverage The builders had requested an increase in lot coverage from 50% for only the dwelling and 55% for all building and structures, to simply 55% for all buildings and structures. This would have been to permit a unit with a two car garage on the rear lane to be attached to the dwelling by a single storey hallway. Through discussions with the applicant and builders the models for these units were reduced in size and therefore there is no longer the need to provide 55% lot coverage for all buildings and structures. The rear yard amenity area for the lane based units will be approximately 40 sq. metres. Lane -based single detached units in Phase 1 have a similar rear yard size. The green turf option will provide an enlarged amenity area when not being used for a third vehicle. Attachment 3 shows the site typologies for both one car garages and two car garages. Chain Link Fencing along West Property Boundary One resident expressed concern about the possibility of construction waste being moved or blown onto his property and requested a chain link fence. The Tree Preservation Plan requires the preservation of trees along the west property boundary. The installation of a chain link fence would require the removal of some trees, which is contrary to the approved Tree Preservation Plan. During the construction period the developer will be responsible for a fencing barrier to control construction debris blowing onto the rear lots of the Maple Grove residents. The applicant has advised staff that he is committed to ensuring that the builders keep the site neat and tidy and that should debris related to the construction activity be found on adjoining properties, it will be removed. Experience to date has shown the builders to be responsible with their sites. If necessary, the Municipality can also take action under the provisions of the Subdivision Agreement. 10.2 The proposed changes do not offend the principles established in the Brookhill Secondary Plan. Staff reviewed the density for the portion of the Brookhill Neighbourhood west of Green Road and determined that based on approved and planned development approximately 70 people and jobs per hectare can still be achieved should this amendment be approved. The parkette, which is near completion, is surrounded by homes and will remain the central focus of the neighbourhood. The variety of lots sizes and unit types being offered is still appropriate for the neighbourhood, particularly with Phase 1 containing townhouses, common -wall semi's, linked and single units. E-IMO 10.3 All taxes payable to the Municipality of Clarington have been paid in full. 11. CONCURRENCE — Not Applicable 12. CONCLUSION PAGE 10 12.1 In consideration of the comments received from circulated agencies and area residents, and based on review of the proposal, staff recommends that the proposed amendment to Draft Approved Plan of Subdivision and Zoning By -law Amendment be approved. LAND CHARACTERISTICS AND SURROUNDING USES 3.1 The subject property is located on the south side of Spicer Square in Bowmanville (23 Spicer Square) and is currently vacant. The site has approximately 88.85 metres of frontage on Spicer Square and (North) and 96.55 metres of frontage on Highway 401 (South). 3.2 The surrounding uses are as follows (see Figure 1): North - Across Spicer Square, a motor vehicle sales and service establishment (Clarington Toyota). South - Highway 401. East - Motor vehicle sales and service establishment (Clarington Hyundai). West - Motor vehicle sales and service establishment (Clarington Honda). 8 -21 REPORT . ZONING BY -LAW 4.1 The applicant has requested a sign measuring 8.0 metres in height while Section 7.11 of the Sign By -law currently allows 7.5 metres. 4.2 A copy of the location plan and monolith sign design drawing are enclosed as Attachments 1 and 2. 5. DEPARTMENTAL COMMENTS 5.1 The intent of Sign By -law 2009 -0123 is to ensure that signs are compatible with the planned land uses within the Municipality while allowing residents, businesses, industries and institutions to achieve their branding and promotional requirements. 5.2 The applicant has requested an increase of the maximum height from 7.5 metres to 8.0 metres. The property where the sign has been proposed is adjacent to three motor vehicle sales and service establishments. The maximum heights approved for the monolith signs of Clarington Honda (2007), Clarington Toyota (2003), and Clarington Hyundai (2005) range between 7.5 metres to 8.0 metres. DISCUSSION 6.1 The proposed increase of .50 metres from the 7.5 metres permitted by Sign By -law 2009 -0123 is compatible with the existing signs in the surrounding area. The visual impact of the proposed monolith sign within the overall context of similar signs scale, and massing within the Bowmanville Auto Mall will be negligible. It is a Highway Commercial Area and not a Town Centre. 6.2 The proposed sign for Clarington Nissan and the existing signs for Honda, Clarington Toyota, and Clarington Hyundai contain similar design elements such as a solid contiguous base, elongated rectangular shape with the sign logo on the top, and branding colours and materials which complement the architectural themes of the properties where these signs are located. 6.3 The proposed sign design complies with all other regulations of Sign By -law 2009 -0123. 7. CONCURRENCE — Not Applicable 8. CONCLUSION 8.1 The property owners are looking to maximize the exposure for their business while providing for signage that is compatible with the existing signs of the other dealerships in the area. Staff believe that permitting an increase in the monolith sign to 8.0 metres is appropriate for the subject property and will conform with the intent of the Sign By- law 2009 -0123. 8.2 Therefore, it is respectfully recommended that the amendment to Sign By -law 2009- 0123, to permit the a monolith sign measuring 8.0 metres be APPROVED and that a by -law be passed by Council to adopt the amendment as contained in Report PSD- 012 -13. The agreement required the developer to construct all roadworks, including hot -mix paving, street trees, sodded drainage ditches and street lights, hereinafter referred to as the 'Works'. 1.2 The Subdivision Agreement provides for the separation of the Works into four (4) stages: a) Initial Works; b) Final Works; c) Street Lighting System; and d) Stormwater Management System (not applicable) 1.3 The Initial Works and Street Lighting System were issued 'Certificates of Completion' and subsequent 'Certificates of Acceptance' by the Director of Engineering Services, as per the maintenance requirements set out in the Subdivision Agreement. 1.4 The Final Works were issued a 'Certificate of Completion' dated September 11, 2011. This initiated a one (1) year maintenance period, which expired on September 11, 2012. The Senior Citizens and Physically Disabled Sidewalk and Driveway Windrow Snow Clearing Program has been offered each winter season since. Over time the program was expanded to include Bowmanville and Courtice as well as the surrounding hamlet areas. In 1993 Council approved a motion to include the remaining hamlet areas. In August of 2009 the economic climate caused a budget shortfall requiring Council to take remedial action. At that time Resolution C- 575 -09 was passed resulting in the cancellation of the Senior Citizens and Physically Disabled Sidewalk and Driveway Windrow Snow Clearing Program. On November 9, 2009 in response to residents, Council passed Resolution #C- 664-09 stating: "THAT, the annual administrative fee for the 200912010 Senior and physically disabled Sidewalk/Windrow Snow Clearing Service be set at $60 per registered property. " Each subsequent year Council has not increased the fees for this service. Senior citizens must provide a copy of a birth certificate or Senior Citizens Number; physically disabled applicants must provide a doctor's certificate. 3.0 VETERANS AFFAIRS CANADA In 2001 Veterans Affairs Canada(VAC) adopted a definition of a veteran which read as follows: "VAC and the Department of National Defense (DND) have extended veteran status to former Canadian Forces members and Reserve Force members who meet DND's Military Occupational Classification requirements (MOC qualified); and have been released from the Forces with an Honourable Discharge ". Veterans Affairs Canada has the responsibility for pensions /benefits and services for war veterans, retired personnel of the Canadian Forces and Royal Canadian Mounted Police. Veterans Independence Program (VIP) The Veterans Independence Program provides veterans financial assistance to help them remain healthy and independent in their own homes and communities. 10 -3 The complete list of available services is varied and includes grounds maintenance such as snow removal and grass cutting. Attachment 1 is the VIP brochure highlighting available services and eligibility. VIP participants typically receive $1,300 per year towards grounds maintenance. Once a veteran is approved renewal is automatic for as long as needed. The spouse or caregiver of a veteran has right of survivorship to these benefits. Staff met with Mr. John Greenfield of the Bowmanville Legion to discuss the VIP program and how it might help meet the needs of veterans in our community. Mr. Greenfield has assisted many veterans with the application process and is very knowledgeable on the application process and rules of acceptance. Mr. Greenfield advised that since 2001 VAC has relaxed the rules for acceptance to the VIP and that veterans previously denied benefits under this program should reapply. Assistance is available to any Canadian veteran, regardless of their affiliation with the Legion. Membership is not required to receive aid with either the application process or the VIP itself. Mr. Greenfield feels that Veterans have the opportunity to receive financial assistance from Veterans Affairs. 4.0 CONCLUSION Staff recommends that no changes be made to the current program. The program was put in place in 1981 to help clients remain healthy and independent in their own homes or communities. VIP does not replace other federal, provincial or municipal programs. Instead, it complements these programs to best meet the needs of our clients. VIP is only available in Canada. It cannot be offered to clients who live outside Canada. If you are a veteran and qualify for VIP, the services you receive will depend on your circumstances and health needs. These services may include: • grounds maintenance, including grass cutting and snow removal; • housekeeping, including help with routine tasks such as doing the laundry, cleaning your home, or preparing meals; • personal care services to assist you with personal needs, such as bathing, dressing, and eating; • access to nutrition services, like Meals on Wheels and Wheels to Meals; and • health and support services provided by health professionals. 10 -6 ambulatory. health care for certain health and social services provided outside the home, such as adult day care, and travel costs to get to these services; transportation costs for other .activities such as shopping, banking, attending senior citizen centres and churches, and visiting friends when transportation is not otherwise - available; home adaptations to modify things like bathrooms, kitchens and doorways so that it is easier for you to do basic everyday activities such as prepare a meal, keep yourself clean, and sleep. Home adaptations do not include general renovations or repairs; and nursing home care when living at home is no longer practical and you need a greater level of nursing and personal help. 1� Most clients who receive VIP are veterans. You may qualify for VIP if you are: a disability'pensioner who needs VIP for your pensioned condition(s) - 10 =7 a wartime (First World War, Second World War and Korean War) pensioner with a disability that is pensioned at 48% or higher. VIP services will be based solely on need; a disability pensioner with a number of health conditions that, together with your pensioned condition, places you at risk. In this case, VIP services will be based on need; a wartime veteran who qualifies because of low income (based on the War Veterans Allowance Act); a totally disabled former prisoner of war; an overseas service veteran; or a disability pensioner who is at home on a waitlist for a Priority Access Bed; and im a civilian, such as an overseas service civilian, who qualifies for support from our Department. Primary Caregivers You may qualify for VIP housekeeping and /or grounds maintenance services if you were the primary caregiver of a veteran who: • qualified for these VIP services anytime after the program began in April, 1981; and • was receiving these services at the time he /she passed away or was admitted to a long -term care facility. Most primary caregivers are spouses or common - law partners, but adult children or other individuals also may qualify. M / you must need the services to remain independent in your home but your health prevents you from doing these tasks; and at the time a veteran passed away or was admitted to a long -term care facility, you: — were primarily responsible for making sure that care was provided to the veteran; — did not receive a wage to'provide this care; — lived in the principal residence of the veteran' and maintained the veteran, or was maintained by the veteran, for a continuous period of at least one year; and — meet other eligibility criteria. If the veteran you cared for received both housekeeping and grounds maintenance services, then you will qualify for both. However, if the veteran only received one of these services (such as grounds maintenance services), then this is the only service that will be available to you. Once you qualify for VIP, you will receive the services for as long as you need them. In 1981, the Council of the Town of Newcastle passed a by -law authorizing the Game Commission to issue licenses to hunt pheasants and rabbits. The Game Commission has ceased to operate, however, the Municipality has taken over the issuance of these licenses. When the Game Commission operated in the Municipality, it was responsible for releasing pheasants on the Kendal Crown Land and the selling of licenses authorizing the hunting of pheasants or rabbits. The proceeds from the sale of the licenses helped to offset the cost of the pheasants. In 2008, the Ontario Federation of Anglers and Hunters advised that they were looking into the possibility of taking over management of the Kendal property from the Ministry of Natural Resources, however we have been advised by the Ministry that these plans have gone no further and the management of the land is still the responsibility of the Ministry. The pheasant hunt on the property has not occurred for a number of years. Since 2010, the Municipality has sold only three hunting licenses (one in 2010 and two in 2012). In accordance with section 79(6) of the Fish and Wildlife Conservation Act, 1997, the Ministry has authorized the repeal of the By -law (see Attachment No. 1). The repeal of this by -law does not exempt hunters from obtaining licenses altogether; they are still required to obtain both a Federal and a Provincial license in order to hunt within the Municipality of Clarington and must comply with the Municipality's Firearms By -law as to where hunting can take place. There is currently provision in the Firearms By -law that requires a municipal license to be issued, so an amendment to this by -law will also be required. 3. CONCURRENCE - Not applicable 4. To strike taxes from the roll it must be by reason of a decision under Section 357 or 358, or of a decision of a judge of any court that the taxes are uncollectible. 1.4 An application for a cancellation, reduction or refund may be made for one of the following reasons: • Ceased to be liable to be taxed at rate it was; • real property becomes exempt; • razed by fire, demolition or otherwise; • damaged by fire, demolition or otherwise (substantially unusable) • removal of a mobile unit; • sickness or extreme poverty; • gross or manifest clerical error; and • repairs /renovations preventing normal use of period of 3 months. 1.5 The 357 and the 358 process begins when an application is prepared by either the Regional Assessment Office or the Tax Department. The neighbourhood - assessor will perform an on -site inspection of the property. The assessor will verify the reason for the application, the period of time for which the tax relief is claimed, and the amount and type of assessment that is affected. The application is then sent back to the Tax Department where the actual tax adjustment is calculated and the taxpayer's account adjusted. 1.6 Section 356, deals with severances or divisions into parcels. These parcels of land were taxed in blocks in the year(s) prior to severance /consolidation. Taxes are being apportioned to the individual properties which are now severed /consolidated. Therefore, tax amounts are removed from one roll number and applied to another roll number as determined by MPAC. 15 -2 REPORT NO.: FND- 002 -13 PAGE 3 2.0 CONCLUSION 2.1 The total amount of taxes to be written off, for September 1, 2012 to December 31, 2012, as shown in this report total $37,336.28. The total for the 2012 calendar year was $121,284.53. This total represents the Municipality's share only. For comparison, the values of taxes written off under Section 357 and 358 at December 31, 2011 was $124,503.62 for the municipal portion only.
