Subject: ISSUANCE OF HUNTING LICENSES
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report CLD-003-13 be received;
2. THAT By-law 81-22 authorizing the issuance of licenses to hunt in the
Municipality be repealed;
3. THAT By-law 2001-098 regulating the discharge of guns and other firearms be
amended accordingly; and
4. THAT the Ministry of Natural Resources be advised of Council's decision.

1. BACKGROUND
In 1981, the Council of the Town of Newcastle passed a by-law authorizing the
Game Commission to issue licenses to hunt pheasants and rabbits. The Game
Commission has ceased to operate, however, the Municipality has taken over the
issuance of these licenses.
2. COMMENTS
When the Game Commission operated in the Municipality, it was responsible for
releasing pheasants on the Kendal Crown Land and the selling of licenses
authorizing the hunting of pheasants or rabbits. The proceeds from the sale of the
licenses helped to offset the cost of the pheasants.
In 2008, the Ontario Federation of Anglers and Hunters advised that they were
looking into the possibility of taking over management of the Kendal property from
the Ministry of Natural Resources, however we have been advised by the Ministry
that these plans have gone no further and the management of the land is still the
responsibility of the Ministry. The pheasant hunt on the property has not occurred
for a number of years.
Since 2010, the Municipality has sold only three hunting licenses (one in 2010 and
two in 2012). In accordance with section 79(6) of the Fish and Wildlife Conservation
Act, 1997, the Ministry has authorized the repeal of the By-law (see Attachment
No. 1). The repeal of this by-law does not exempt hunters from obtaining licenses
altogether; they are still required to obtain both a Federal and a Provincial license in
order to hunt within the Municipality of Clarington and must comply with the
Municipality's Firearms By-law as to where hunting can take place. There is
currently provision in the Firearms By-law that requires a municipal license to be
issued, so an amendment to this by-law will also be required.

4. CONCLUSION
Given that the Municipality is issuing so few hunting licenses and has received
Ministerial approval to do so, it is respectfully recommended that By-law 81-22 which
authorizes the issuance of licenses to hunt pheasants and rabbits during open
season be repealed and that the Municipality's Firearms By-law be amended
accordingly.

As requested in your correspondence dated September 25, 2012, please accept this letter as
formal permission to repeal By-law 81-22 of the Municipality of Clarington regarding the
issuance of municipal licences to hunt pheasant and rabbit during the open season.
Please be advised that this requirement has now been flagged for removal from the provincial
hunting regulations and regulations summary.
Should the Municipality of Clarington wish to re-establish your municipal licence you will need to
submit a new request/proposal to MNR for approval.
