(NISSAN) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PSD-012-13 be received; 2. THAT the application for Amendment to the Clarington Sign By-law 2009-0123, submitted by 2316057 Ontario Ltd., to permit a monolith sign with a height of 8.0 metres, be approved and that the By-law, contained in attachment 3 to Report PSD- 012-13 be passed; and 3. APPLICATION DETAILS 1.1 Agent: Wes Surdyka Architect Inc. 1.2 Applicant: 2316057 Ontario Ltd. 1.3 Proposal: To permit a monolith sign for Clarington Nissan with a height of 8.0 metres 1.4 Area: 8,199.60 sq.m. (2.0 acres) 1.5 Location: 23 Spicer Square, Bowmanville 2. BACKGROUND 2.1 On October 25, 2012 Surdyka Architect Inc. submitted an application for Sign By-law Amendment to permit a monolith sign for Clarington Nissan with a height of 8.0 metres. A site plan application has been approved to permit a 1,011.65 sq. m. motor vehicle sales establishment and accessory repair garage. 2.2 The site plan proposes a monolith sign located at the north west side of the site. The sign will be setback 2.00 metres from the property line facing Spicer Square. 3. LAND CHARACTERISTICS AND SURROUNDING USES 3.1 The subject property is located on the south side of Spicer Square in Bowmanville (23 Spicer Square) and is currently vacant. The site has approximately 88.85 metres of frontage on Spicer Square and (North) and 96.55 metres of frontage on Highway 401 (South). 3.2 The surrounding uses are as follows (see Figure 1): North - Across Spicer Square, a motor vehicle sales and service establishment (Clarington Toyota). South - Highway 401. East - Motor vehicle sales and service establishment (Clarington Hyundai). West - Motor vehicle sales and service establishment (Clarington Honda). ZONING BY-LAW 4.1 The applicant has requested a sign measuring 8.0 metres in height while Section 7.11 of the Sign By-law currently allows 7.5 metres. 4.2 A copy of the location plan and monolith sign design drawing are enclosed as Attachments 1 and 2. 5. DEPARTMENTAL COMMENTS 5.1 The intent of Sign By-law 2009-0123 is to ensure that signs are compatible with the planned land uses within the Municipality while allowing residents, businesses, industries and institutions to achieve their branding and promotional requirements. 5.2 The applicant has requested an increase of the maximum height from 7.5 metres to 8.0 metres. The property where the sign has been proposed is adjacent to three motor vehicle sales and service establishments. The maximum heights approved for the monolith signs of Clarington Honda (2007), Clarington Toyota (2003), and Clarington Hyundai (2005) range between 7.5 metres to 8.0 metres. DISCUSSION 6.1 The proposed increase of .50 metres from the 7.5 metres permitted by Sign By-law 2009-0123 is compatible with the existing signs in the surrounding area. The visual impact of the proposed monolith sign within the overall context of similar signs scale, and massing within the Bowmanville Auto Mall will be negligible. It is a Highway Commercial Area and not a Town Centre. 6.2 The proposed sign for Clarington Nissan and the existing signs for Honda, Clarington Toyota, and Clarington Hyundai contain similar design elements such as a solid contiguous base, elongated rectangular shape with the sign logo on the top, and branding colours and materials which complement the architectural themes of the properties where these signs are located. 6.3 The proposed sign design complies with all other regulations of Sign By-law 2009-0123. 7. CONCURRENCE — Not Applicable 8. CONCLUSION 8.1 The property owners are looking to maximize the exposure for their business while providing for signage that is compatible with the existing signs of the other dealerships in the area. Staff believe that permitting an increase in the monolith sign to 8.0 metres is appropriate for the subject property and will conform with the intent of the Sign By- law 2009-0123. 8.2 Therefore, it is respectfully recommended that the amendment to Sign By-law 2009- 0123, to permit the a monolith sign measuring 8.0 metres be APPROVED and that a by-law be passed by Council to adopt the amendment as contained in Report PSD- 012-13. Section 9—EXCEPTIONS BY AMENDMENT is hereby amended by inserting the following new subsection: "9.26 Notwithstanding Section 7.11, one monolith sign with a maximum height of 8.0 metres is permitted at 23 Spicer Square in Bowmanville".
