SUBJECT: AMENDMENT TO PARKING BY -LAW TO PROVIDE
FOR DESIGNATED PARKING SPACE FOR MAYOR
AND FOR PHYSICALLY HANDICAPPED PERSONS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD -71 -89 be received; and
2. THAT the attached by -law, being a by -law to amend the Town's Parking By -law
79 -1 to provide for on- street reserve parking for physically handicapped
persons and for the Mayor be approved; and
3. THAT a copy of the amending by -law be forwarded to Mr. Mike Swaga of Durham
Regional Police #16 Division.
REPORT
1. The south side of Church Street, west of Temperance Street, abutting the
Municipal Building has been identified for reserved parking spaces for
physically handicapped persons and for the Mayor.

2. In order to ensure these parking spaces are not abused and that there
are effective enforcement thereof, the Town's Parking By-law 79-1 will
have to be amended to provide for the designated parking as well as
for penalties.
3. The municipal Act allows the municipality to regulate parking and to
issue permit for parking on public highways and the amending by-law
will legitimize the said reserved parking spaces.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW NUMBER 89-
being a By -law to amend By -law 79 -1 as amended for the regulating of
parking, standing or stopping on highways under the jurisdiction of the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to designate for on- street reserve parking space for physically
handicapped persons and for the Mayor of the Municipality.
AND WHEREAS the Section 210, Subsections 118 and 119 of the Municipal Act
(R.S.O. 1980) allows the municipality to enact a by -law to regulate permit
parking on public highways.
NOW THEREFORE be it enacted by the Corporation of the Town of Newcastle by
the Council thereof as follows:
1. Notwithstanding any provisions with respect to parking regulations
on public highways contained in By -law 79 -1 as amended, no person shall
park or stop any vehicle on the south side of Church Street for a distance
seventy (70) feet westerly from Temperance Street save and except for the
following:
a) Any physically handicapped person may park or stop any vehicle
within the specified location as signed provided the vehicle
carries proper identification as vehicle used by physically
handicapped person.
b) The Mayor of the Town of Newcastle may park or stop any vehicle
within the specified location as signed.
2. Any person who contravenes the provisions of this By -law is subject
to a fine and penalty as determined under the Provincial Offence Act.
