SJBJECT: REZONING APPLICATION - NINO SCANGA
PART LOTS 19 & 20, CONCESSION 2

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD -74 -89 be received; and
2. THAT the application to amend By -law 84 -63 submitted by Mr. Nino Scanga to
permit the development of a fuel bar and eating establishment, be referred
back to Staff for a subsequent report pending receipt of all outstanding
comments; and
3. THAT the applicants be so advised.
1. BACKGROUND
1.1 On November 15, 1988, the Planning and Development Department received an
application to amend By -law 84 -63, to permit the development of a fuel bar
and an eating establishment on a .37 hectare parcel of land.

1.2 The application involves two (2) abutting parcels; one currently zoned
"Residential Hamlet (RH)" and the other "Residential Hamlet Exception
(RH -10) ". Each lot currently supports single family dwellings and
accessory building. One dwelling will be removed and a fuel bar and
kiosk will be located in its place; the other dwelling will remain and
be converted into an eating establishment.
2. OFFICIAL PLAN CONFORMITY
2.1 The subject property is located in the Maple Grove area, which is
identified as "Hamlet" in the Durham Region Official Plan. Section
10.4.1.1 of the Regional Plan provides that the predominant land use in
Hamlet areas shall be residential. Other land uses, including limited
commercial may also be permitted in Hamlet areas, subject to the
inclusion of appropriate requirements in the respective zoning by -law.
In addition, Section 8.3.3.3 of the Regional Plan outlines the
provisions for assessing the location of the fuel bar aspect of the
proposed development.
3. LOCATION
3.1 The subject lands are located on the north side of Kings Highway No.
2, between Maple Grove Road and Holt Road, being Part Lots 19 and 20,
Concession 2, former Township of Darlington, in the Maple Grove area.

5. PUBLIC NOTICE AND SUBMISSIONS
5.1 Pursuant to Council's resolution of July 26, 1982 and the requirements
of the Planning Act, the appropriate signage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each landowner within the prescribed
distance.
5.2 As of the writing of this report, no written submissions have been
received.
6. AGENCY COMMENTS
6.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies.
The following is a summary of the comments received thus far.
6.2 The Town of Newcastle Public Works Department offered no objection to
this proposal in principle, however, the department must received and
review a preliminary site grading plan which addresses the existing
watercourse and the surrounding proposed grading. When the applicant
has addressed the concern of the Department, the applicant would be
required to enter into a Site Plan Agreement with the Town of
Newcastle, where all requirements, financially and otherwise, will be
met.
6.3 The Town of Newcastle Fire Department noted a concern as the site is
not serviced by municipal water, therefore a tanker truck is required
for firefighting.
6.4 The Regional Health Services Department offered no objection to the
development of the fuel bar. However, a site plan indicating the
location of the tile bed and a hydrogeologic assessment with
perculation rates will be required prior to comments for an eating
establishment.

6.5 The Ministry of Transportation will only permit one (1) commercial
entrance with no additional direct access to Highway No. 2. The
Ministry will require any new commercial access be set back a minimum
distance of 14m from Highway property line. In addition, the
appropriate permits will be required from the Ministry.
6.6 Staff would note for the Committee's information that comments are
still outstanding from the following departments /agencies.
Central Lake Ontario Conservation Authority
Regional Planning Department
7. COMMENTS
7.1 The subject property is located in Maple Grove, designated as a
"Hamlet" in the Regional Official Plan. Staff would note that there
is no development plan in effect for Maple Grove at this time.
However, it is anticipated that a Hamlet Development Plan will be
prepared by Staff within 1989. Therefore, Staff is of the opinion
that the hamlet plan, when completed, would be beneficial in reviewing
this particular proposal.
7.2 In order to ensure that an adequate supply of potable water is
available for the proposed development, the applicant is required to
retain a qualified Engineer to prepare a Hydrogeological Report based
on test drilling to demonstrate that there is an adequate supply of
acceptable quality of potable water, and further demonstrate that
there will be no cross - contamination with any existing or future
septic system and that there will be no detrimental impact on
neighbouring wells.

8. RECOMMENDATION
8.1 In consideration of the comments and as this report is to
facilitate a Public Meeting in accordance with the Planning Act' Staff
would respectfully cecununeod that the application be referred back to
Staff for a oobaegoeut report.
