SUBJECT: REZONING APPLICATION - BRUCE & PAMELA WELSH
PART LOT 35, CONCESSION-3, FORMER TOWNSHIP OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD -75 -89 be received; and
2. THAT the application submitted by Bruce and Pamela Welsh to amend By -law
84 -63, to permit the creation of one (1) residential lot for the
development of one single family dwelling be referred back to Staff for
further processing; and
3. THAT the applicant be so advised.
1. BACKGROUND:
1.1 On December 5, 1988 the Planning and Development Department received an
application to amend By -law 84 -63 to permit the creation of one
residential lot, for the construction of one single family dwelling.

1.2 The subject lands have 62.48 metres of frontage and .84 hectares of lot
area, being Parts 2 and 3 of 1OR 722. Part 2 is a 66 ft. right of way
to serve the lands to the rear of the subject property (see attached).
The lot to be created would be adjacent to the right -of -way, with a
proposed frontage of 17.16 metres and approximately 936 sq. metres of
lot area. The lot would appear to comply with the appropriate zoning
provisions of an Urban Residential zoning category.
2. LOCATION:
2.1 The subject lands are located on the west side of Varcoe Road, north of
Nash Road also known as 98 Varcoe Road, being Part Lot 35, Concession
3, former Township of Darlington.
3 SURROUNDING LAND USES:
3.1 The existing land uses adjacent to the property are as follows:
To the north: a 66 ft. right of way and residential
To the east: residential plan of subdivision being 10M 787
To the west: residential and vacant
To the south: residential
4. PUBLIC NOTICE AND SUBMISSIONS:
4.1 Pursuant to Council's resolution of July 26, 1982 and the requirements
of the Planning Act the appropriate signage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each landowner within the prescribed
distance.
4.2 As of the writing of this report, no written submissions have been
received.

5. AGENCY COMMENTS:
5.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies. The
following departments /agencies in providing comments, offered no
objection to the application as filed:
Town of Newcaatle Fire Department
Durham Regional Health Services
Durham Regional Planning
5.2 The Town of Newcastle Public Works Department offered no objection to
the proposal however, requested that a 0.3 metre reserve and 6 metre by
10 metre sight triangle be dedicated to the Town on the north -east
corner of the proposed lot. The applicant is also required to provide a
cash contribution for the endeavouring to collect clause for the
construction of Varcoe Road by Schleiss and Holland. In addition, a lot
grading plan be provided, satisfactory to the Director of Public Works.
5.3 The Town of Newcastle Community Services Department offered no
objection, however, requested 5% cash -in -lieu of parkland dedication
for the proposed lot.
5.4 The Region of Durham Public Works Department offered no objection to
the creation of the lot, noting that municipal water and sanitary sewer
services are available to the subject property from Varcoe Road.
5.5 Staff would note that comments are still outstanding from Central Lake
Ontario Conservation Authority.

6. STAFF COMMENTS:
6.1 Within the Durham Regional Official Plan and the Town of Newcastle
Official Plan, Courtice Urban Area, the subject lands are designated
"Low Density Residential. Residential uses and uses accessory thereto
are permitted within said designation. Staff is currently preparing
a Neighbourhood Development Plan for this area and is considering the
possibility of an access for a collector in the vicinity of the subject
lands. Given this, the proposed lot, may become a corner lot in the
future.
7. RECOMMENDATION:
7.1 This report is prepared for the purpose of facilitating a public
meeting in accordance with the Planning Act requirements. Once Staff
have ascertained the possibility of an access for a collector in the
Neighbourhood Plan, and pending receipt of outstanding comments,Staff
will be in a position to report back to Committee with respect to this
application.
