By -Law # MEETING: General Purpose and Administration Committee DATE: MONDAY, MARCH 20, 1989 REPORT #: PD -78 -89 FILE #: DEV 88 -118 SLRJECT: REZONING APPLICATION - TERRY PRICE PART LOT 6, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON DEV 88 -118 RECOPMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -78 -89 be received; and 2. THAT Staff be authorized to refund Mr. Terry Price the cost of rezoning fees since the application is not necessary for the proposal; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On February 6, 1989, members of Committee had before them Staff Report PD -31 -89 in consideration of an application submitted by Mr. Terry Price to rezone a .8 hectare parcel of land to permit the development of a farm produce and garden retail outlet. ...2 530 . � .1 :' PAGE 2 1.2 The application was referred back to Staff for further processing, and in order for Staff to liaise with a representative of Newcastle Hydro Electric Commission, noting that the Commission members had concerns with the proposed access and the the possibility of traffic congestion at the intersection of Highway No. 2 and Lambs Road. 1.3 On February 20th., 1989, Staff met with representatives of Newcastle Hydro and they were given the opportunity to review the proposal. Subsequently, on February 24, 1989, Staff received correspondence from the Commission offering no objection to the proposal. 1.4 In addition to the foregoing, PD -31 -89 indicated that Staff was unable to ascertain if the applicant intended to sell produce grown on his farm as well as other farm units and the length of time, whether it would be on a year -round basis or a seasonal basis. These details were essential in determining if a rezoning application was necessary. 2. COMMENTS: 2.1 Through discussions and written confirmation from the applicant, Staff have been able to ascertain that the produce sold will only be that produce on the farm owned by the Price family and will be sold on a seasonal basis. Given this information, the proposal would comply to Section 11.2.3 of the Durham Regional Official Plan, stating that retail stands for the sale of agricultural products produced on the farm unit are permitted. In addition, the sale of agricultural products produced on the farm unit would comply with the definition of farm as indicated within By -law 84 -63. Therefore given the information the rezoning application is not necessary. 2.2 Staff have also discussed the issue with the Building Department and would note for Committee's information that a Building Permit will be required for the construction of the stand. ...3 531 REPORT NO.: PD-78-89 3. : PAGE 3 ______________________________________________ 3.1 Given the above noted information, Staff would respectfully recommend that the fees for rezoning be refunded.
