SU&JECT: OFFICIAL PLAN AMENDMENT
NEIGHBOURHOOD DEVELOPMENT PLAN AMENDMENT
ZONING BY -LAW AMENDMENT
APPLICANT: H. KASSINGER CONSTRUCTION LTD.
PART LOT 32, CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON
RECOMMENDATIONS:
pectfully recommended that the General Purpose and Administration
Committee recomend to Council the following:
1. THAT Report PD -89 -88 be received; and
2. THAT the applications to amend the Town of Newcastle Official Plan,
Courtice North Neighbourhood Development Plan and Zoning By -law 84 -63
submitted by D. G. Biddle and Associoates Ltd. on behalf of H.
Kassinger Construction Ltd. to permit the development of twenty four (24)
residential lots, be approved; and
3. THAT the amending documents attached hereto be forwarded to Council for
approval; and
4. THAT the Region of Durham be so advised; and
5. THAT the interested parties, attached hereto, be so advised.

1. BACKGOUND

1.1 On December 5, 1988, the Planning and Development Department received
two (2) applications to amend Zoning By -law 84 -63 of the Town of
Newcastle and the Courtice North Neighbourhood Development Plan.
Subsequently, on December 29, 1988, the Town was advised by the Region
of Durham to amend the Town of Newcastle Official Plan, Courtice Urban
Area. In addition, an application for Plan of Subdivision was also
received for twenty -four (24) residential units.
1.2 The proposed amendments to the Town's Official Plan and the
Neighbourhood Plan would delete the 'Elementary School' symbol on each
of the appropriate schedules.
1.3 The amendment to the Town's Zoning By -law would permit the development
of twenty -four single family dwellings as shown in the proposed Plan of
Subdivision.
2. LOCATION
2.1 The subject lands are within an existing Plan of Subdivision and have
been identified as Block 119 on Registered Plan 10M 819, being Phase 1
of Highland Gardens developed by Kassinger Construction.
2.2 Phase II of the subdivision will begin once the Plan is Registered.
Staff would note that registration will take place shortly. The
development of the proposed subdivision will be the Third Phase.
2.3 The lands to the north, east and south of the subject lands are all
developed, residentially. The lands to the west are delineated as a
park block in the entire Plan of Subdivision.

3.1 Within the Town of Newcastle Official Plan certain public recreational
and community uses which are compatible with surrounding uses may be
permitted in residential neighbourhoods. Such uses shall be churches,
community centres, libraries, schools, parks, playgrounds and other
similar uses.
3.2 The school sites indicated on the schedules to the Official Plan are
conceptual, the exact location shall be determined through the
appropriate Neighbourhood Development Plans.
3.3 The Courtice North Neighbourhood Plan stipulates that the exact
location of school facilities are to be depicted and redefined during
the subdivision approval process and be done so in conjunction with the
appropriate educational authority.
3.4 Within the Courtice Urban Area the overall density shall be considered
'Low Density Residential' and shall not exceed a density of 15 units
per net residential hectare. Staff would note that the addition of
twenty four (24) units would not exceed the prescribed limit.
4. PUBLIC NOTICE AND SUBMISSIONS
4.1 Pursuant to Council's resolution of July 26, 1982 and the requirements
of the Planning Act the approprrate signage acknowledging the
application was installed on the subject lands. In addition, the
appropriate notice was mailed to each land owner within the prescribed
distance.
4.2 As of the writing of this report, no written submissions have been
received.

5. AGENCY COMMENTS
5.1 In accordance with departmental procedures, the applications were
circulated to obtain comments from other departments and agencies. The
following departments /agencies in providing comments, offered no
objection to the principle of the Official Plan Amendment,
Neighbourhood Development Plan Amendment and Zoning By -law Amendment.

Peterborough - Victoria Northumberland - Newcastle Roman Catholic
Separate School Board
Northumberland Newcastle Board of Education
5.2 The Town of Newcastle Community Services Department offered no
objection, however, requested that a walkway be provided in the area of
lots 9 to 11. The west boundaries of lots 1 to 11 abutting the park,
be fenced. In addition, a 5% cash-in-lieu of parkland be payed to the
Town of Newcastle.
5.3 The Town of Newcastle Fire Department noted a concern with the level of
service that can be achieved to provide service to the 24 units.
However, should the application be approved, no building permit shall be
issued until access routes are in compliance with the appropriate
sections of the Ontario Building Code and Ontario Fire Code. In
addition, adequate water for fire fighting shall also be available in
accordance with the Ontario Fire Code and Ontario Bulding Code.
5.4 The Town of Newcastle Public Works Department offered no objection to
the principle of the development, however, will provide Staff with the
conditions of draft approval when a detail examination has been
completed.

5.5 The Ministry of Natural Resources and Central Lake Ontario Conservation
Authority offered no objection to the proposed amendments. However,
each agency has recognized that Block 119 has been approved as part of a
larger overall draft plan, therefore the majority of conditions of draft
approval would still apply. This will be addressed through the draft
conditions by the Region of Durham.
5.6 The Region of Durham Works Department have also offered no objection to
the proposal, however, have also requested conditions of draft approval
for the servicing issues.
5.7 Staff would note that comments are still outstanding from the Ministry
of Environment.
6. COMMENTS
6.1 In reviewing the comments from the various agencies, Staff note there
were no objections to the proposed amendments.
6.2 Staff of the Town and Region had requested comments from both the
Northumberland Newcastle Board of Education and the Peterborough
Victoria Northumberland Newcastle Roman Catholic Board of Education,
each agency offered no objection to deleting the school site from each
of the Plans.
6.3 The proposed twenty four (24) single family dwellings would be well
within the keeping of the intent of the Official Plan and the
Neighbourhood Development Plan as well as within the keeping of the
surrounding land uses. Staff would note that the subject lands are
currently zoned 'R11. The proposed lots would be 12.6 metres in
frontage and would require an 'R2' zoning category.
6.4 The conditions imposed by the Town of Newcastle Community Services
Department and the Town of Newcastle Public Works Department will be
imposed when the Plan of Subdivision is further examined by Staff and a
further report brought to Committee for their consideration.

7.1 In consideration of the above noted comments, Staff would respectfully
recommend that the applications to amend the Town of Newcastle Official
Plan, Courtice North Neighbourhood Development Plan be approved. The
amending By-law be approved with a 'Holding (H)' symbol placed on the
residential zone and will not be removed until such time as the
Subdivision has been approved and an Agreement has been executed.

AMENDMENT NO. 3 TO THE NEIGHBOURHOOD DEVELOPMENT PLAN
FOR COURTICE NORTH NEIGHBOURHOOD 3A
PURPOSE: The Purpose of this Amendment is to delete the 'Elementary School'
land use symbol to permit the development of a twenty four (24) lot
Plan of Subdivision.
LOCATION: The subject property is located within the limits of the Subdivision
known as Highland Gardens, east and south of George Reynolds Drive,
situated west of Trulls Road, north of Nash Road, Part Lot 31,
Concession 3, former Township of Darlington.
BASIS: The amendment is the result of an application to delete the
'Elementary School' land use symbol within the Town of Newcastle
Official Plan and (Courtice North 3A Neighbourhood Development Plan),
to permit the development of a twenty -four (24) unit Plan of
Subdivision. The Town of Newcastle Official Plan requires parks and
school blocks to be designated within each Neighbourhood as
indicated in each of the Courtice Neighbourhood Development Plans.
The Separate and Public School Boards have advised that the school
block identified, on Schedule 1 of the Courtice North Neighbourhood
Development Plan 3A is not required, the lands are therefore
appropriate for residential development.
ACTUAL AMENDMENT:
The Courtice North Neighbourhood Development Plan 3A is hereby amended
as follows:
1. by deleting the 'Elementary School' symbol from Schedule 1 and be
redesignated to 'Residential' as indicated on Schedule 'X'
attached.
IMPLEMENTATION:
The provisions set forth in the Neighbourhood Development Plan for
Courtice North Neighbourhood 3A, as amended, regarding the
implementation of the Plan shall apply in regard to this amendment.
INTERPRETATION:
The provisions set forth in the Neighbourhood Development Plan for
Courtice North Neighbourhood 3A, as amended, regarding the
interpretation of the Plan shall apply in regard to this Amendment.
