AND MARILYN CARSWELL PLAN 1OR-708 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ROADWAYS AND STORM DRAINAGE SYSTEM i RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-90-89 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' dated October 2, 1989, for the roads, storm drainage system and street lighting constructed within Plan 1OR-708; and i 3 . THAT Council pass the by-law attached to Report WD-90-89 assuming the streets within Plan 1OR-708 as public highways, and assumed by the Town for public use. --------------------------------------------------------------------------- REPORT 1. BACKGROUND 2 . 1 The Town entered into a subdivision agreement on July 26, 1978, with Darlington Industrials Limited and Marilyn Carswell to develop lands by plan of subdivision, commonly referred to as Darlington Industrial Park located in the former Township of Darlington and described as Plan 1OM-708 (see Attachment No.2) . the agreement required Darlington Industrial Ltd. et al to construct roads, including hot-mix paving and granular shoulders, sodding of ditches, drainage works and street lighting. 2 .2 In May of 1979 , the subdivision was issued a 'Certificate of Completion' . However, the project remained outstanding for approximately 8 years pending the completion of surface asphalt and gravel shouldering. 2 .3 These outstanding items were completed on July 1, 1987, and were placed on the final two year maintenance period. The two year maintenance period expired on June 30, 1989, and the works have been re-inspected and were found to be satisfactory. 2 .4 It is now appropriate to issue a 'Certificate of Acceptance' of the works in Stage II thereby accepting ownership of the roads, storm drainage works and street lights. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2 .5 Further to the issuance of a 'Certificate of Acceptance' , a by-law is required for the Town to assume all the streets within Plan 1OR-708 . 3 . RECOMMENDATION 3 . 1 It is, therefore, recommended that the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lights within Plan 1OR-708 and that Council pass the by-law attached to this report (WD-90-89) assuming the streets within Plan 1OR-708 . 1 . . .3 REPORT NO. : WD-90-89 PAGE 3 Respectfully submitted, Recommended for presentation to the Committee, ----------------------- ------- -------------------- Walter A. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows; 1. THAT the streets described in Registered Plan 1OM-708 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Thwn of Newcastle shown as the owner of the streets in Plan 10M-708.
