'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW'
ROADWAYS AND STORM DRAINAGE SYSTEM

RECOMMENDATIONS: It is respectfully recommended that the General Purpose and
and Administration Committee recommend to Council the following:
1. THAT Report WD-80-89 be received;
2. THAT the Director of Public Works be authorized to issue a 'Certificate of
Acceptance' for the roads, storm drainage system and street lighting
constucted within Plan 1OM-784; and
3. THAT Council approve the by-law attached to this report (WD-80-89)
assuming the streets within Plan 1OM-784 as public highways, and assumed by
the Town for public use.

2. BACKGROUND
2.1 The Town entered into a subdivision agreement on November 24, 1982, with
Halimen Homes Limited to develop lands by plan of subdivision, located
in the former Township of Darlington and described as Plan 1OM-784
(see Attachment No.l) . The agreement required Halimen Homes Limited
to construct roads, including hot-mix paving and granular shoulders, sodding
of ditches, drainage works and street lighting.

2.2 on November 17, 1986, a 'Certificate of Completion' was issued and the
works were placed on a one year maintenance period which expired on
November 17, 1986. These works were subsequently re-inspected and were
found to be satisfactory.
2.3 It is now appropriate to issue a "Certificate of Acceptance" dated
October 30, 1989, for these works, thereby accepting ownership of the
roads, storm drainage system and street lights. The subdivision agreement
provides for this certificate to be issued by the Director of Public Works,
subject to the approval of Council.
2.5 Further to the issuance of a "Certificate of Acceptance", a by-law is required
permitting the Town to assume all the streets within Plan 1OM-784.
3.0 RECOMMENDATION
3.1 It is, therefore, recommended that the Director of Public Works be authorized
to issue a "Certificate of Acceptance" for the roads, storm drainage system
and street lights within Plan 1OM-784 and that Council approve the By-law
attached to this report (WD-80-89) assuming the streets within Plan
1OM-784.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUBMER 89-
Bein g a By-Law to assume certain streets within the Town of Newcastle as

public highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle
enacts as follows;
1. THAT the streets described in Registered Plan 1OM-784 (described in
Schedule "A" attached hereto and forming part of this By-Law) all
being in the Zbwn of Newcastle, in the Regional Municipality of Durham,
are hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for public use.
2. THAT the Clerk be authorized to apply to the Land Registry Office to
have the Corporation of the Town of Newcastle shown as the owner of
the streets in Plan 1OM-784.
