'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW'
ROADWAYS AND STORM DRAINAGE SYSTEM
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
and Administration Committee recommend to Council the following:
1. THAT Report WD-79-89 be received;
2. THAT the Director of Public Works be authorized to issue a 'Certificate of
Acceptance' for the roads, drainage works and street lights constructed in
within Plans 1OM-771 and 1OM-778; and
3. THAT Council approve the by-law attached to this report (WD-79-89)
assuming the streets within Plans 1OM-771 and 1OM-778 as public
highways, and assumed by the Town for public use.

2. BACKGROUND
2.1 The Town entered into a subdivision agreement on November 29, 1985, with
Luverme Investments Limited to develop lands by plan of subdivision, located
in the former Township of Darlington and described as Plans 1OM-771 and
1OM-778 (see Attachment No.1) . The agreement required Luverme Investments
Limited to construct roads, including hot-mix paving and granular
shoulders, sodding of ditches, drainage works and street lighting.
2.2 On December 1, 1987 a 'Certificate of Completion' was issued and the
works were placed on a one year maintenance period which expired on
December 1, 1987. These works were subsequently re-inspected and were
found to be satisfactory.
2.3 It is now appropriate to issue a "Certificate of Acceptance" dated
October 30, 1989, for these works, thereby accepting ownership of the
roads, storm drainage system and street lights. The subdivision agreement
provides for this certificate to be issued by the Director of Public Works,
subject to the approval of Council.
2.5 Further to the issuance of a "Certificate of Acceptance", a by-law is required
permitting the Town to assume all the streets within Plans 1OM-771 and
1OM-778.
3.0 RECOMMENDATION
3.1 It is, therefore, recommended that the Director of Public works be authorized
to issue a "Certificate of Acceptance" for the roads, storm drainage system
and street lights within Plan 1OM-771 and 1OM-778 and that council approve
the By-law attached to this report (WD-79-89) assuming the streets within Plan
1OM-771 and 1OM-778.

BY-LAW NUMBER 89-
being a By-Law to assume certain streets within Registered Plans 1OM-771
and IOM-778 as public highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle
enacts as follows:
1. THAT the streets described in Registered Plans 1OM-771 and 1OM-778
(described in Schedule 'A' attached hereto and forming part of this
By-Law) all being in the Town of Newcastle, in the Regional
Municipality of Durham, are hereby accepted by the Corporation of
the Town of Newcastle as public highways, and assumed by the said
Corporation for public use.
2. THAT the Clerk be authorized to apply to the Land registry Office to
have the Corporation of the Town of Newcastle shown as the owner of
the streets on Plans 1OM-771 and 1OM-778.
