It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report WD-75-89 be received;
2. THAT By-Law 88-155 be amended to reflect the change in the contract with
Browning-Ferris Industries to provide for the collection of leaves at cost
plus 15% for profit; and
3. THAT Browning-Ferris Industries be advised of Council's decision.

1.1 On Tuesday, September 26, I989/ Report WM89-48 (Attachment No°I) , was
considered by the Region's Solid Waste Management Committee. As noted
on Page 3 of Report WM89-48, we have advised the Region's staff that
it is intended that the Tbwu will collect the leaves on Mondays and will '
deliver special bag tags (provided by the Region) and a flyer which will
explain the composting program to residents and identify collection days. �
2° COLLECTION OF LEAVES

2°1 We have negotiated the collection of leaves in the Town with our contractor, �

Browning-Ferris Industries and they have agreed to collect leaves in the Town
on Mondays only, on October 30' Non/ember 6, 13, 20 and 27.

Therefore, the Town will have a net saving of $43,663 calculated as follows:
Cost which the Tbwn would have to pay if the leaves where
disposed of at the Brock West Landfill Site $91,663
Minus the payment to Browning-Feris Industries for the
collection and disposal of the leaves at a leaf
composting site $48,000

Recomendation
A. THAT this report he received for information;
B. THAT the disposal of leaves be banned from Region landfill s 1 t es effective
October 1 , 1989;
C. AND THAT the Ministry of the Environment be advise(I that an Environmental
Assessment Board Hearing is not required for the proposed Leaf Composting
Sites in Oshawa and Brock and that the City of Oshawa and the Township of
Brock be requested to pass similar resolutions .
Report
Metropolitan Toronto recently banned leaves from the Brock West Landfill Site
(see Correspondence WMC 46-89 Attachment No. 1) .
Works Department staff have held meetings with the representatives of the Area
Municipalities over the last month to co-ordinate a full scale leaf composting
initiative for the Fall Of 1989. All Area Municipalities who agree to
participate In this project will provide for collection of leaves . Details on
how each municipality intends to conduct this collection and where the leaves
can be taken for composting is proposed as follows:

The Region will provide biodegradable bags to the Township of Brock for leaf
collection (see separate Report WM89-49). These bags will be available at
the Town Hall where residents can pick them Up. The Township is also
investigating a separate curbside leaf collection . In any event , residents
will be allowed to deliver their leaves to the Brock Township Landfill Site,
where Durham Region will develop a leaf composting site .

Leaf collection bags will be provided by the Region to the Town Hall where
residents will be able to pick up the bags . The Township is negotiating with a
local nursery to accept the leaves for composting. In any event, Uxbridge
residents will be able to take their leaves to a bin at the Pedersen Landfill
for subsequent transfer to the composting operation at the Brock Township
Landfill Site .

The Region will make bags available to the Town Hall where residents will be
able to pick them up. A bin will be placed at the Scugog Landfill Site where
residents can drop their leaves off . These leaves will be hauled for
composting at the Brock Township Landfill Site .
Town of Pickeri9l
The Town of Pickering staff have decided not to distribute bays for leaf
collection , and will collect leaves curbside in regular garbage bags on regular
garbage collection days .
Considering the uncertainty about the suitability of biodegradable plastic bags
for composting, Region staff concur with this approach and recommend limiting
the supply of bags to Uxbridge, Scugog and Brock for the Fall of 1989, The
Region will provide special bag tags which , when affixed by the householder ,
will clearly identify the bags as containing leaves . An accompanying flyer
will explain the composting program to residents and identify collection days .
The Town of Pickering passed a resolution refusing Metropolitan Toronto' s
request to develop leaf composting operations at the Brock North Site in
Pickering . Therefore, leaves collected from Pickering will be taken to leaf
composting sites in Whitby and/or Oshawa .

affixed by the householder, will clearly identify the bags as containing
leaves . An accompanying flyer will explain the composting program to residents
and identify collection days . Leaves collected froin Whitby will be taken to
the leaf composting site in Whitby.

and identify collection days . Leaves collected from Newcastle will be taken to
leaf composting sites in Whitby and/or Oshawa .

Uxbridge , Scugog and Brock will be provided with biodegradable bags . This now
generation of biodegradable plastic has been developed specifically for
composting operations . In co-operation with the University of Guelph, the
Region will be testing the hags to See if they do break down sufficiently in a
composting operation .
Ban on Landfill Disposal of Leaves
Since the Region has provided leaf composting facilities to the Area
Municipalities, It is appropriate to ban leaves from all Region landfill
sites .

Oshawa and Brock, in addition to the facility developed last year in Whitby.

RE: LEAF COMPOSTING
Tn an effort to tedUce the amount of solid waste requiring
disposal, Metropolitan Council has bari-ried the:, disposal of leaves
at all Metropolitan Toronto disposal facilities effective
September, 1989, since this material can be easily diverted from
the waste stream and composted, As a result, leaves will not
be accepted for disposal at the Brock West Landfill Site this
fall or in future years.
This Department has been actively searching for additional
suitable lands to compost the expected increase in leaf volumes.
Our current leaf composting site at thy: Avondale Borrow Pit
north of the Keele Valley Landfill Site can only accommodate a
portion of the leaves expected to be recovered this fall.
We have requested the Town of Pickering to allow Metropolitan
Toronto to carry out leaf composting operations at the Brock
North Site, however, their Town Council has pas5ed a resolution
refusing our request.
In view of this resolution, we would suggest that• the Region of
Durham arrange with its member municipalities the implementation
of a program to Collect leaves separately from streets and from
the public for composting at municipally operated compost sites
or sitas operated by the private sector.

SUBJSCT: Leaf Collection And Leaf Composting
Attached please find a letter. from Metropolitan Toronto Works
Department, indicating that Metro will no longer be receiving leaves
at the Brock Went Landfi.11 Site as of September, 1989.
The Region of Durham has established a Staff Committee with
representatives from the Region Works DepArtment, and the vari,us area
Municipalities to deal with Waste Management. For 1989, the Region is
offering a Leaf Composting Program to area Municipalities whereby the
Region provides clear bags made of Cornstarch to the area
Municipalities for distribution to the homeowers Who are in turn
requested to place the leaves in the clear bags at the curb on
designated leaf collection days to be collected by the area
4 i Municipality in a separate collection from that of the regular
garbage. The collected leaves would then be accepted at the Region' s
CoinpQsting site.
In the 1989 Budget , the Town of Ajax did not budget for separate
collection of leaves which would require additional equipment and
manpower for an approximate 4 week period in the Fall of 1989. It
would appear now that the Town of Ajax must initiate a aeparate Leaf
Collection Program for 1989 and Must do 00 immediately, so that
&quiPment can be arranged for collection routes set up and bags
distributed to the Town residents.
Recommendation

1 ) That Staff be authorized to establish a separate Leaf Collection
Program for the Fall of 1989 with all costs associated with this
Program Charged to the Base Budget .
2) That Staff be authorized to negotiate with Durham Region for the
supply of garbage bags and a disposal, site for leaf composting .
3 ) That Durham Region be notified of Council ' s action by copy of thie

THAT 30.000 biodegradable plastic bags be purchase(( from PCL Packaging for the
Fall 1989 Leaf Composting Project in Uxbridge, Scugog and Brock.

The St. Lawrence Starch Co. Ltd. and the Ontario Corn Producers Association are
interested in demonstrating biodegradable plastic bag suitability for
Composting operations. As such, they have arranged for PCL Packaging, a
manufacturer of biodegradable plastic bags to supply Durham Region with 30,000
bags at manufacturer's cost. In Addition , DUrhaill Region has been guaranteed
that the bags will biodegrade In composting operations. If the Region is not
satisfied with the performance of the bag, PCL will romove them from the
windrows at their expense. The manufacturer has agreed to Supply us with the
bags at a cost of $0.16/bag for the first 10,000 bags and $0.25/bag for all
others . Therefore, the total cost will be $6,600.00.
The biodegradable bags will be utilized on a trial hasis in the Townships of
Scugog , Brock and Uxbridge as part of the Durham Region' s Fall 1989 Leaf
Composting Project. The University of Guelph will be involved in this leaf
composting trial project.
This report has been discussed with the Finance Department who concur with the
recommendation.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 88-155
Being a By-Law to authorize the entering into of a
Contract Agreement between the Corporation of the
Town of Newcastle and Browning-Ferris Industries
WHEREAS Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980,. provides
that By-laws may be passed for establishing and maintaining a system for
the collection, removal and disposal of household refuse and household
trash and for contracting with any person for the collection, removal and
disposal of household refuse and household trash upon such terms and
conditions as may be considered expedient;
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle,
pursuant to Section 210 (83) of the Ontario Municipal Act, R.S.O. 1980,
ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf
of the Corporation of the Town of Newcastle, and seal with the Corporate
Seal, a Contract Agreement between Browning-Ferris Industries and
the said Corporation dated this 11th day of October 1988which Contract
Agreement is attached hereto as Attachment #1, including the General
Conditions and Specifications attached thereto being Schedules "A"
and "B", respectively..
2. THAT this By-law not take effect until approved by the Ontario Municipal
Board, pursuant to Section 64 (1) of the Ontario Municipal Board Act.
3. . THAT By-law 82-184 is hereby repealed.

BY-LAW 89176
Being a By-Law to amend By-Law 88-155, a By-Law to
authorize the entering into of a Contract Agreement
between the Corporation of the Zbwn of Newcastle
and Browning- Ferris Industries.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
expedient to amend By-Law 88-155 of the Corporation of the Zbwn of Newcastle,
being a by-law to authorize the entering into of a Contract Agreement
between the Corporation of the Town of Newcastle and Browning-Ferris
Industries;
NOW THEREFORE, the Council of the Corporation of the Town of Newcastle,
pursuant to Section 210 (83) of the Municipal Act, R.S.O. , 1980,
ENACTS AS FOLLOWS:
1. THAT the contract between the Corporation of the Town of Newcastle
and Browning-Ferris Industries be amended to include the collection of
leaves at cost plus 15% for profit;
2. THAT the Mayor and Clerk be authorized to execute, on behalf of the
Corporation of the Town of Newcastle, and seal with the Corporate
Seal, an amending contract agreement between Browning-Ferris Industries
and the Corporation of the Zbwn of Newcastle, dated this day of 1989
attached hereto as Schedule "A" and forming part of this by-law.
3. THAT this by-law not take effect until approved by the Ontario Municipal
Board, pursuant to Section 64 (1) of the Ontario Municipal Board Act.

SCHEDULE "A" TO BY-LAW 89-176
This amending agreement dated October 16, 1989, being an amendment
to the original agreement dated December 16, 1988, between the
Corporation of the Town of Newcastle and Browning-Ferris
Industries.
BETWEEN: The Corporation of the Town of Newcastle
hereinafter called the "TOWN"
of the first part
AND: Browning-Ferris Industries
hereinafter called the "CONTRACTOR"
of the second part
WHEREAS the Town of Newcastle has been advised by the Region of
Durham that effective September 1, 1989, leaves will no longer be
accepted at the Brock West Landfill Site, and whereas the
alternative is to collect leaves separately on designated
collection days and deliver to a designated site for composting by
the Region of Durham;
NOW THEREFORE this amending agreement specifies that the Town of
Newcastle and Contractor agree as followst
1. That leaves will not be picked up with regular household waste
and household trash.
2 . Leaves will be picked up by the Contractor under separate
collection, for five (5) consecutive Mondays, commencing
October 30, 1989.
3. Leaves will be hauled to the designated compost sites in
either Whitby or Oshawa.
4 . Payment will be based on the Contractors actual Collection
Costs plus 15% for profit.
5. Invoices and payment to be as per terms of the Contract
General Conditions Schedule 'A', Clause 6 Payment.
6 . Except as specifically herein amended all remaining general
conditions, specification, schedules and agreements, shall
remain in effect.
IN WITNESS WHEREOF, The Parties have hereunto affixed their
corporate seals, attested to by the hands of their proper officers
in that behalf fully authorized.
